RESOLUTION [To Set a Public Hearing to Declare the Abundance of Overgrown Grass and Weeds at 208 Meharry Street, 432 Summerhill Road, and 1504 South Memorial Drive, to be Unsafe and a Public Nuisance and Order Their Abatement Pursuant to Chapter 46 et seq., City of Prattville Code of Ordinances.] WHEREAS, an abundance of overgrown grass and weeds: 1. is injurious to the public health, safety, and general welfare of the community by providing a breeding ground and shelter for rats, mice, snakes and mosquitoes, and other vermin; 2. may cause the further spread of weeds; 3. may hide debris, such as glass or metal, that could inflict injury on a person going to such property; 4. may also pose a fire hazard and respiratory hazard; and WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected the properties and determined the existence of an abundance of overgrown grass and weeds at 208 Meharry Street, 432 Summerhill Road, and 1504 South Memorial Drive; and WHEREAS, the Autauga County tax records list the property owner(s) as follows: 208 Meharry Street – Mickey Annie C/O Kenneth L. Robinson, with an address of 11904 Stirling Field Drive, Pinefield, NC 28134, to Parcel Number 19 03 05 4 002 007.000; 432 Summerhill Road – Tucker Tonya Teresa & Livingston Lovell, with an address of 432 Summerhill Road, Prattville, AL 36067, to Parcel Number 19 05 16 4 010 001.076; 1504 South Memorial Drive – Renaissance Baptist Church, with an address of 1504 South Memorial Drive, Prattville, AL 36067, to Parcel Number 19 06 23 4 000 024.000; and WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the Code Enforcement Officer gave written notice to the owner(s) of said properties on September 19, 2025, October 3, 2025, and October 3, 2025, respectively, to correct, remedy, or remove the abundance of grass and weeds within ten (10) days; and WHEREAS, the owner(s) of said properties have failed and/or refused to correct, remedy, or remove said condition by the expiration of said notice; and WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City Council to declare the abundance of overgrown grass and weeds to be a public nuisance and abate the same; and WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering their abatement by the City Council initiates a fine for the first violation and designation on the repeat offender registry. NOW, THEREFORE, BE IT RESOLVED THAT: 1. the City Council of the City of Prattville declares the abundance of overgrown grass and weeds at said properties to be a public nuisance and has therefore initiated the abatement process; and 2. the owner(s) of said properties are ordered to abate said nuisance and appear before the City Council at a Public Hearing at 6:00 p.m. on November 18, 2025, at Prattville City Hall; and 3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the Public Hearing; and 4. the fine of $100.00 shall be assessed to the owner(s) of said properties in addition to any costs incurred for the abatement process; and 5. said properties shall be placed on the repeat offender registry for a period of three (3) years; and 6. the notice of Public Hearing on the matter, as required by law, will be provided in a publication of general circulation, by certified mail, and by signage on the subject properties.
