ORDINANCE NO. 5135 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHANDLER, ARIZONA, GRANTING A NON-EXCLUSIVE POWER DISTRIBUTION EASEMENT TO SALT RIVER PROJECT AGRICULTURAL IMPROVEMENT AND POWER DISTRICT, AT NO COST, FOR ELECTRICAL FACILITIES RELOCATION REQUIRED AS PART OF THE LINDSAY ROAD IMPROVEMENT PROJECT FROM OCOTILLO ROAD TO HUNT HIGHWAY. WHEREAS, the City of Chandler will be improving Lindsay Road from Ocotillo Road to Hunt Highway (the “Project”); and WHEREAS, in order to accommodate the construction of the Project, Salt River Project Agricultural Improvement and Power District’s (SRP) electrical facilities along the county road frontages on the east side of Lindsay Road must be relocated and converted to underground facilities; and WHEREAS, the City of Chandler is willing to grant a non-exclusive Power Distribution Easement (the “Easement”) to SRP, at no cost, for the relocated facilities; and WHEREAS, the City of Chandler is still in the process of acquiring all of the necessary property to be conveyed to SRP, therefore the City may execute more than one Easement instrument while acquisitions are finalized on the remaining parcels. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Chandler, Arizona, as follows: Section 1. That the City Council of the City of Chandler, Arizona, authorizes and approves the granting of the Easement to SRP, at no cost, in, upon, over, under, across, through, and along that certain property legally described and depicted in the Easement instrument. Section 2. That the granting of the Easement(s) shall be in substantially the form approved by the City Attorney attached hereto as Exhibit “A”. Section 3. That the Mayor of the City of Chandler, Arizona, is hereby authorized to execute the Easement and this Ordinance on behalf of the City. Section 4. That the City Clerk shall cause the original or a certified copy of this Ordinance to be recorded in the Office of Maricopa County Recorder after the effective date of this Ordinance.
