NOTICE OF SALE
In accordance with the Judgment and Decree of Foreclosure by Judicial Sale filed on June 19, 2019, in the above captioned action brought to foreclose that certain mortgage given by John Green to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Franklin American Mortgage Company, a Tennessee Corporation, dated September 12, 2017, and recorded in Book 480, at Page 359, of the Town of Milton Land Records, of which mortgage the undersigned is the present holder by Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc. as nominee for Franklin American Mortgage Company to Franklin American Mortgage Company recorded in Book 487, at Page 165 and subsequent acquisition of Franklin American Mortgage Company by Citizens Bank, N.A., for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on December 3, 2025 at 03:00 PM at 78 Woodcrest Circle, Milton, VT 05468 all and singular the premises described in said mortgage,
To Wit:
Being all and the same land and premises conveyed to John Green by Warranty Deed of Randall S. Martello dated September 12, 2017 and recorded in Volume 480, Page 357 of the Milton Town Land Records.
Being all and the same land and premises conveyed to Randall S. Martello and Deborah K. Martello (deceased) by Warranty Deed of John Babcock and Bambi J. Shanahan (f/k/a Bambi L. Babcock) dated June 28, 2004 and recorded in Volume 298, Page 679 of the Milton Town Land Records and more particularly described therein as follows:
Being all and the same lands and premises conveyed to John Babcock and Bambi L. Babcock by Warranty Deed of Bruce A. Spaulding and Linda L. Spaulding dated September 18, 1992 and recorded in Volume 143, Page 295 of the Milton Town Land Records.
Being Lot No. 160, together with all buildings thereon, as shown on a Plan entitled “Milton Meadows, Milton, Vermont” recorded in Volume 3, Page 23 of Maps of the Milton Town Land Records (the “Plan”), and being further described as follows:
Beginning at a point marked by the intersection of Lots #159 and #160 and Woodcrest Circle as depicted on the Plan; thence extending N 41 degrees 30' 00" E for a distance of 73.00 feet to a point; thence deflecting to the left and extending N 30 degrees 23' 27" E a distance of 162.86 feet to a point; thence deflecting to the right and extending easterly for a distance of 121.91 feet to a point marking the intersection of the northeast corner of Lot #160 with the northwest corner of Lot #161; thence deflecting to the right and proceeding in a southerly direction for a distance of 225.46 feet to a point on the northerly sideline of Woodcrest Circle; thence deflecting to the right and proceeding in and along the northerly sideline for a distance of 99.11 feet to the point or place of beginning.
Included with said Lot is a right of way for pedestrians and vehicles over any portion of Woodcrest Circle not yet accepted by the Town of Milton as a public street.
Reference is hereby made to the aforementioned instruments, the records thereof and the references therein contained, all in further aid of this description.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale.
Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. The sale is subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens, if any, which take precedence over the said mortgage above described.
The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
