NOTICE OF SALE
In accordance with the Judgment and Decree of Foreclosure by Judicial Sale filed on September 17, 2025, in the above captioned action brought to foreclose that certain mortgage given by Lawrence P. Brunette and Ruthine A. Brunette to Financial Freedom Senior Funding Corporation, a Subsidiary of Indymac Bank, F.S.B., dated April 9, 2008, and recorded in Book 1031, at Page 547, of the City of Burlington Land Records, of which mortgage the undersigned is the present holder by virtue of the following Assignments of Mortgage: (1) Assignment of Mortgage from Financial Freedom Senior Funding Corporation to Mortgage Electronic Registration Systems, Inc. (“MERS”), as nominee for Financial Freedom Acquisition LLC recorded in Book 1085, at Page 146 (2) Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc. as nominee for Financial Freedom Acquisition LLC to Cit Bank, N.A. recorded in Book 1297, at Page 311 (3) Assignment of Mortgage from Cit Bank, N.A. to Bank of New York Mellon Trust Company, N.A., as Trustee for Mortgage Assets Management Series I Trust recorded in Book 1432, at Page 301 (4) Assignment of Mortgage from Bank of New York Mellon Trust Company, N.A. as Trustee for Mortgage Assets Management Series I Trust to Cascade Funding Mortgage Trust HB3 recorded in Book 1738, at Page 157 (5) Assignment of Mortgage from Cascade Funding Mortgage Trust HB3 to Wilmington Savings Fund Society, FSB not in its individual capacity, but solely as Acquisition Trustee for Cascade Funding Mortgage Trust HB13 recorded in Book 1746, at Page 105 (6) Assignment of Mortgage from Wilmington Savings Fund Society, FSB, not in its individual capacity but solely in its capacity as Acquisition Trustee for Cascade Funding Mortgage Trust HB13 to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Owner Trustee for Cascade Funding Mortgage Trust HB13 recorded in Book 1764, at Page 227, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on December 3, 2025 at 04:00 PM at 85 Randy Lane, Burlington, VT 05408 all and singular the premises described in said mortgage,
To Wit:
Being all and the same land and premises conveyed to Lawrence P. Brunette and Ruthine A. Brunette by Warranty Deed of Adrien B. Thibault and Roseanne M. Thibault dated July 24, 1972 and recorded August 31, 1972 in Volume 212, Page 441 of the City of Burlington Land Records.
A lot of land with all buildings thereon having a frontage on the westerly side of Randy Lane of 80.00 feet, a southerly sideline of 125.59 feet, and a northerly sideline of 123.13 feet, and a rear line of 81.00 feet, it being Lot #26 of Block E as shown on a plan entitled “Howe Farm Estates, Phase 7, Lot Layout” recorded in Vol. 206 at Page 280 of the City of Burlington Land Records:
Said parcel is a portion of the land and premises conveyed by Warranty Deed of Lorenzo W. and Evelyn T. Howe to the herein Grantors dated April 18, 1968, of record in Vol. 187, Page 722-25 of the City of Burlington Land Records.
Conveyed herewith is a right of way over the streets in said development until such streets are accepted by the City of Burlington as public streets.
No fence shall be erected on said lot without the written consent of the herein Grantors, their heirs, administrators, executors, successors and assigns.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale.
Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. The sale is subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens, if any, which take precedence over the said mortgage above described.
The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
