MORTGAGEE'S SALE
OF REAL ESTATE
By virtue of and in execution of the Power of Sale con-tained in a certain mortgage given by Nicholas Halal to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Liberty Home Equity Solutions, Inc., its successors and assigns, dated April 24, 2015 and recorded in Wor-cester County (Worcester District) Registry of Deeds in Book 53656, Page 63 (the “Mortgage”) of which mortgage PHH Mortgage Corporation is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc, as Mortgagee, as Nominee for Liberty Home Equity Solutions, Inc, its successors and assigns to PHH Mortgage Corporation, its successors and as-signs dated February 14, 2020 and recorded at said Registry of Deeds in Book 61925, Page 21, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises loca-ted at 64 Hunting Avenue, Shrewsbury, MA 01545 will be sold at a Public Auction at 3:00 PM on November 25, 2025, at the mortgaged pre-mises, more particularly de-scribed below, all and singular the premises described in said mortgage, to wit:
The land in Shrewsbury, Worcester County, Massachusetts, situated on the easterly side of South Street and the northerly side of Hunting Avenue, being shown as Lot 1 on plan entitled "Definitive Subdivision Plan, Southview Estates, Shrewsbury, Massachusetts, prepared for Westwood De-vel. Corp." dated May 15, 1985 by E.J. Flynn Engineers, Inc. recorded with Worcester District Registry of Deeds in Plan Book 549, Plan 47, further bounded and described as follows:
BEGINNING at the northwesterly corner thereof at a point in the easterly line of South Street, which point is also the southwesterly cor-ner of land now or formerly of Raoul L. Laurier, et ux;
THENCE N. 83° 25' 05" E. by said Laurier land, 10.39 feet to a point at the end of a stone wall;
THENCE N. 49° 44' 12" E. by said Laurier land and by a stone wall, 200.00 feet to a point at Lot 2 as shown on said plan;
THENCE S. 20° 55' 19" E. by Lot 2, 184.18 feet to a point in the northerly line of Hunting Avenue;
THENCE by said line of Hunting Avenue, by a curve to the left with radius of 225.00 feet, a distance of 88.24 feet to the end of said curve;
THENCE S. 80° 55' 16" W. by said line of Hunting Avenue, 110.08 feet to the beginning of a curve with radius of 30.00 feet connecting said line of Hunting Avenue with the easterly line of South Street;
THENCE by said curve to the right, a distance of 50.94 feet to the end of said curve at the point in the easterly line of South Street;
THENCE N. 05° 25' 54" E. by said line of South Street, 23.30 feet to the point of beginning.
Containing 23,049 square feet of land according to said plan.
For Title see deed in Book 11203 at Page 250 of the Worcester County Registry of Deeds.
Said premises are subject to a road easement 8.5 feet in width along South Street as shown on said plan.
Subject to an easement 10 feet in width to the Shrewsbury Electric Light Plant dated July 29, 1987 and recorded with said Deeds in Book 10677, Page 142.
Subject to Right to Use said Hunting Avenue in common with others as streets are commonly used in the Town of Shrewsbury.
For mortgagor’s title see deed recorded with the Worcester County (Worcester District) Registry of Deeds in Book 53656, Page 59.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Me-morandum of Sale upon ac-ceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
