Petition to Partition Citation (A.C. 92A)
To: Krysta L. Ferry and Dawnmarie Ferrie and to all other persons interested.
A petition has been presented to said Court by Dezi Garcia of Worcester in the County of Worcester representing that he hold as tenants in common undivided part or share of certain land lying in Worcester in said County Worcester and briefly described as follows:
BEGINNING at the Northwesterly corner of the premises to be conveyed at a point on said line of Nanita Street, 245.60 feet easterly from the intersection of the easterly line of Boston Avenue with the said line of Nanita Street; THENCE North 78 degrees 47' E., by said line of Nanita Street 58.50 feet to a point at land now of formerly of one Martin; THENCE South 26 degrees 44' E., by land now or formerly of said martin, 112.80 feet to land of owners unknown; THENCE South 54 degrees 23' W., by said last named land, 65.15 feet to land now or formerly of William Abelson; THENCE North 26 degrees 44' W., by said Abelson land, 40.70 feet to land now or formerly of Pignataro; THENCE North 78 degrees 47' E., 8.20 feet to the southeast corner of said Pignataro land; THENCE North 26 degrees 44' W., 100 feet to the point of beginning; said last two courses being by said land of Pignataro. Containing 7,358 square feet of land, more or less. Said premises are conveyed subject to a sewer easement of the City of Worcester 10' wide as recorded in Book 3047, Page 225, setting forth that he desires that all of the aforesaid described part of said land may be sold at private sale not less than three hundred and ninety thousand (390,000) dollars, and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided either at private sale, and be ordered to distribute the net proceeds thereof. If you desire to object thereto you or your attorney should file a written appearance in said Court at Worcester before ten o’clock in the forenoon on the ninth day of December the return day of this citation.
