WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated April 24, 2009, executed by MATTHEW J SMITH conveying certain real property therein described to RECONTRUST COMPANY, N.A., as Trustee, for MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INC. AS BENEFICIARY, AS NOMINEE FOR COUNTRYWIDE BANK, FSB, Original Beneficiary, to secure the indebtedness therein described, as same appears of record in the Office of the Chancery Clerk of Forrest County, Mississippi filed and recorded May 12, 2009, in Deed Book 1694, Page 0602; and
WHEREAS, the beneficial interest of said Deed of Trust was transferred and assigned to Citibank, N.A., not in its individual capacity but solely as Owner Trustee of New Residential Mortgage Loan Trust 2019-RPL3; and
WHEREAS, Rubin Lublin, LLC has been appointed as Substitute Trustee; and
NOW, THEREFORE, the holder of said Deed of Trust, having requested the undersigned so to do, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee shall, on December 3, 2025 within the lawful hours of sale between 11:00AM and 4:00PM at the northeast main entrance (back door) of the Paul B. Johnson, Jr., Chancery Building, located at 641 Main Street proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Forrest County, Mississippi, to wit:
BEGINNING AT THE SOUTHWEST CORNER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 2, TOWNSHIP 4 NORTH, RANGE 13 WEST, AND RUN NORTH 20 FEET, THENCE CONTINUE NORTH 132 FEET, THENCE RUN EAST PARALLEL WITH FIFTH AVENUE 891 FEET, TO THE POINT OF BEGINNING, THENCE RUN NORTH, AT RIGHT ANGLE 178 FEET, TO FOURTH AVENUE, THENCE RUN EAST ALONG THE SOUTH LINE OF FOURTH AVENUE 99 FEET, THENCE RUN SOUTH 178 FEET, THENCE RUN WEST 99 FEET TO THE POINT OF BEGINNING; FORREST COUNTY, MISSISSIPPI; TOGETHER WITH ALL IMPROVEMENTS THEREON AND APPURTENANCES THEREUNTO BELONGING.
PROPERTY ADDRESS: The street address of the property is believed to be 113 W FOURTH AVE, PETAL, MS 39465. In the event of any discrepancy between this street address and the legal description of the property, the legal description shall control.
Title to the above described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee.
