In execution of a Deed of Trust in the original amount of $85,000.00, dated May 30, 2013, and recorded as Instrument No. 130005048 in the land records of the County of Augusta, Virginia, default having been made in the payments of the indebtedness thereby secured, the undersigned will on
November 18, 2025 @ 11:30 AM
at the front entrance of the Augusta County Circuit Courthouse, 1 E Johnson St, Staunton, VA 24401, offer for sale at public auction the property and improvements thereon, described as follows:
All that certain tract or parcel of land, together with all buildings and improvements thereon and all appurtenances thereto belonging, situate in Riverheads District of Augusta County, Virginia, containing 2.28
acres, more or less, and currently designated as Tax Map #95-92A, consisting of the combination of the following parcels or tracts:
(a) 0.27 acre on the south side of Route 666, designated and described as Parcel "B" on plat entitled "Plat Showing a Portion of Sarah J & John F Fitzgerald, Riverheads Dist, Augusta Co, VA" dated September 10, 1984, prepared by J W Clark, CLS, a copy of which is recorded in the Clerk's Office of the Circuit Court of Augusta County, Virginia, in Deed Book 826, page 796;
(b) 1.139 acres on the south side of Route 666, designated an described as Parcel "A" on plat entitled "Plat Showing a Portion of the Property of Sarah J & John F Fitzgerald, Riverheads Dist, Augusta Co, VA" dated September 10, 1984, prepared by J W Clark, CLS, a copy of which is recorded in the aforesaid Clerk's Office in Deed Book 826, page 796; and
(c) 0.872 acre on the southwest side of State Route 666, and further described and shown on plat entitled "Plat of Portion of Property of John F & Sarah J Fitzgerald, Riverheads District, Augusta Co, VA'' made by J W Harris, LS, dated October 30, 1989, a copy of which is recorded in the aforesaid Clerk's Office in Deed Book 987, page 392.
TERMS OF SALE: CASH
This sale is subject to all matters of record in the chain of title to the above property, and also subject to mechanics' and materialmen's liens of record and not of record, if any such liens exist.
A bidder's deposit of 10% of bid amount, in cash, certified or cashier's check, is required at the time of sale, with the balance due at settlement, to be held within 30 days from the sale date at the office of the Trustee. The property and improvements thereon shall be sold in "as is" condition. All costs of conveyance, by special warranty deed, will be at the cost of the purchaser. Real estate taxes shall be prorated to date of sale. Additional terms of sale shall be announced at the time of sale and contained in a memorandum of sale which the successful bidder shall be required to sign.
