MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Scott A. Davis to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Gateway Funding Diversified Mortgage Services L.P., its successors and assigns, dated February 26, 2010 and recorded in Worcester County (Worcester District) Registry of Deeds in Book 45508, Page 227 (the “Mortgage”), as affected by a Loan Modification Agreement dated January 27, 2016, and recorded at said Registry of Deeds in Book 55073, Page 362 of which mortgage Wells Fargo Bank, N.A. is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for Gateway Funding Diversified Mortgage Services L.P., its successors and assigns to Wells Fargo Bank, NA dated February 12, 2015 and recorded at said Registry of Deeds in Book 53375, Page 194, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 80 Clark Road, Spencer, MA 01562 will be sold at a Public Auction at 3:00 PM on December 2, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
The land together with the buildings and other improvements now or hereafter situated thereon in said Spencer on the southerly side of Clark Road and being shown on a plan of land entitled 'Plan of Land in Spencer, Mass, owned by Carl A. Anderson" dated June 19, 1972, Theodore P. Drazek, R.L.S, said plan being recorded with Worcester District Registry of Deeds in Plan Book 370, Plan 85 and bounded and described as follows:
BEGINNING at a drill hole at a stone wall at land of Joseph Puchalski said point being northwesterly 250.0 feet more or less from the intersection of the westerly line of Buteau Road and the southerly line of Clark Road and being the northeast corner of said Puchalski land as shown on said plan;
THENCE S. 18° 55' 48" W. 216 feet along said wall and Puchalski land to a point;
THENCE N. 54° 20' 40" W. 363.78 feet to a point at an iron pin at land formerly of Carl A. Anderson et ux;
THENCE N. 43° 46' E. 200.0 feet along land formerly of one Custo to a point at an iron pin in the southerly line of Clark Road;
THENCE S. 43° 43' 48" E, 57.67 feet to a point and S. 59° 29' 24" E. 217.60 feet to the point of beginning.
The last two courses being along said southerly line of Clark Road.
For mortgagor’s title see deed recorded with the Worcester County (Worcester District) Registry of Deeds in Book 45508, Page 225.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
