By virtue and in execution of the Power of Sale contained in a certain Commercial Mortgage And Security Agreement dated April 27, 2023 given by Alan L. Carrier AKA Alan Carrier to ASW Fund 1, LP, said mortgage recorded with the Barnstable County Registry of Deeds in Book 35754, Page 28, and which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1:00 p.m. on the 11th day of December 2025 on the premises at 22 Tonset Road, Orleans, MA 02653 and at 1:20 p.m. on the 11th day of December 2025 on the premises at 67 South Orleans Road, Orleans, MA 02653, all and singular the premises described in said mortgage.

a vacant parcel of land containing 2.32 acres, more or less, in Orleans, Barnstable County, Massachusetts, being shown on plan of land entitled: "Plan of Land in Orleans, MA. prepared for Robert S. Berger and Barbara B. Crossen Scale: 1" : 40' June 27, 2000 Ryder & Wilcox, Inc. P.E. & P.L.S. So. Orleans, Ma.", which plan is duly recorded in Barnstable County Registry of Deeds, Plan Book 557, Page 77.
Being the same premises conveyed to this Mortgagor by deed recorded in Book 13539, Page 39.
67 SOUTH ORLEANS ROAD, ORLEANS:
The parcel of land, situate[d] lying and being in the County of Barnstable, Commonwealth of Massachusetts, to wit:
The land in Orleans together with the dwelling house and buildings thereon. bounded and described as follows: On the West by Massachusetts State Highway (Route 28); On the North by land sometime of the heirs of Hiram Myers; On the East by the land sometime of Ambrose Young, now supposed to be Elroy B. Penniman; and On the South by land formerly of Augusta E. Fiske.
Being the same premises conveyed to this Mortgagor by deed recorded in
Book 13025, Page 204.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens and rights of any tenants and parties in possession, if there be any, or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. The successful bidder will pay all costs of recording the foreclosure deed and any other foreclosure documents including, without limitation, all state and county excise stamp fees, and shall also be responsible for any Title V inspection and repair requirements.
Terms of sale: A deposit of Ten Thousand and 00/100 Dollars ($10,000.00) by certified or bank check will be required to bid at the 22 Tonset Road sale, and a deposit of Ten Thousand and 00/100 Dollars ($10,000.00) by certified or bank check will be required to bid at the 67 South Orleans Road sale. The balance is to be paid by certified or bank check to Mirrione, Shaughnessy & Uitti, LLC, 2 Batterymarch Park, Suite 202 Quincy, MA 02169 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
