TAKE NOTICE that a hearing to declare the manufactured home located at 1315 King Road, Lot 31, Clifton Springs, New York 14432 abandoned will be held on December 16, 2025, at 9:45 A.M. before the Ontario County Supreme Court, County of Ontario, located at 27 North Main Street, Canandaigua, New York 14424. TAKE FURTHER NOTICE that if Respondents shall fail at such time to interpose and establish any defense that Respondents may have to petition, Respondents may be precluded from asserting such defense, or the claim on which it is based, in any other proceeding. TAKE FURTHER NOTICE that a final judgment may be rendered if the court finds that the petitioner has made the requisite showing; and that the result of that final judgment shall be the loss of the resident-respondent’s home. TAKE FURTHER NOTICE that demand is hereby made that you make an answer to the petition at least three days before the aforesaid date by serving an Answer upon Adams Leclair LLP, attorneys for Petitioner. WHEREFORE, demand is made in the petition for a declaration that the manufactured home has been abandoned, for an order stating that the manufactured home may be sold in lieu of removing the manufactured home, for judgment for all amounts due to Petition, and for such other and further relief set forth therein. The foregoing notice is served upon you via publication pursuant to the Order of the Honorable Kristina A. Karle, J.S.C., dated October 31, 2025, and filed with the Petition and other supporting papers with the Office of the Clerk of the County of Ontario on October 31, 2025. This is an action pursuant to RPAPL § 792 in which Petitioner Prestige MHC LLC seeks a declaration that the Respondents, Andrea Butters and Aaron Butters as heirs to the Estate of Geoffrey R. Butters have abandoned the Decedent’s manufactured home located at 1315 King Road, Lot 31, Clifton Springs, New York 14432. If all Respondents fail to respond, the Home will be deemed abandoned and sold, with Petitioner retaining the value of past-due rent totaling $80,520.00.
