NOTICE IS HEREBY GIVEN that Applicant, Tommy's Freehold, LLC, has made application to the Freehold Township Planning Board for amended preliminary and final major site plan approval with variance relief and soil removal permit for the construction of a parking lot expansion for the existing Tommy's Tavern and Tap located at 3492 Route 9, Freehold, New Jersey and designated as lot 18 in block 71 on the tax map of the Township of Freehold which is owned by 3492 RT 9 Partners, LLC. The proposed parking lot expansion will be located on the adjacent lot 17 in block 71 that is commonly known as 3494 Route 9, Freehold, New Jersey and owned by 3494 Route 9 Holdings, LLC. Lots 17 and 18 are to be consolidated to form a single lot. Applicant further proposes to replace the existing outdoor dining tent structure surrounding the existing patio at the Tommy's Tavern and Tap with a permanent metal structure with a louvered roof and glass guillotine windows. Applicant proposes associated site improvements including the modification of a portion of the existing parking lot on lot 18 to accommodate circulation and connection with the proposed parking lot expansion on lot 17, concrete curbing, sidewalk, porous pavement for stormwater management, below grade stormwater infrastructure, lighting, landscaping, sidewalk along lot 17 frontage, demolishing and removing the existing building, storage trailer, and asphalt parking area on lot 17, and provide a right out only egress on lot 17 that will function in conjunction with the existing right in/right out driveway on lot 18. The subject properties contain approximately 0.502 acres of land for lot 17 and approximately 2.936 acres of land for lot 18 with both being located Corporate Multi Use 10 Acres (CMX-10) zone. Applicant does not propose any changes to the existing operation of Tommy's Tavern and Tap.
Applicant seeks bulk "c" variance relief for: the maximum impervious coverage where 60% is permitted and approximately 64.8% is proposed for the combined lots; the expansion of the proposed parking area within the 100-foot front yard setback along Route 9 on lot 17; and parking stall size where 9.5 feet by 19 feet is required and 9 feet by 18 feet is proposed.
Applicant also seeks the continuation of any and all previously granted variances, waivers, approvals, interpretations and/or such other relief including, without limitation, any and all use "d" variances, conditional use variances, bulk "c" variances, waivers, permits, interpretations, as well as any and all other, new variances, waivers, approvals, interpretations and/or such other relief including, without limitation, any and all use "d" variances, conditional use variances, bulk "c" variances, waivers, permits, interpretations, as the Planning Board or its professionals may deem necessary, or which may be required for the purposes of this application.
A public hearing has been scheduled by the Planning Board on this application for December 4, 2025 at 7:00 p.m. or as soon thereafter as the matter may be heard at the Freehold Township Municipal Building, 1 Municipal Plaza, Freehold Township, New Jersey. At such time, anyone interested in this application may appear and provide testimony regarding the application. For specific details of the application, copies of all documents submitted in support of the application by the applicant are on file and available for review at least ten (10) days before the public hearing by the public at the offices of the Freehold Township Planning Board at the Freehold Township Municipal Building during normal municipal building business hours.
This notice is being given by the Applicant by direction of the Planning Board pursuant to statute.
