MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Polar Views LLC to Steven A. Ross, Trustee of QS Lending Three Trust, dated February 22, 2024 and recorded on February 23, 2024 with the Worcester County Registry of Deeds in Book 70223, Page 246 of which mortgage the undersigned is the present holder, and in which the mortgaged premises consist of a certain parcel of land with the buildings and improvements thereon located in Worcester known as 111-113 Austin Street, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00AM on the 17th day of December 2025, at the mortgaged premises located at 111-113 Austin Street, Worcester, Worcester County, Massachusetts, all and singular the premises described in said mortgage.
To wit:
Beginning at a point located at the northwesterly corner of Lot 24, situated on the southerly side of Austin Street, said point being about sixty-three and seventy hundredths (63.70) feet easterly from the intersection of the easterly line of Newbury Street with the southerly line of Austin Street;
Thence southerly, by land now or formerly of Alfred C. and Stephanie A. Pisegna, about one hundred and ten and thirty hundredths (110.30) feet to a point;
Thence southeasterly, by land now or formerly of Thomas R. Savasta, about forty-one and seventy-five hundredths (41.75) feet to a point;
Thence northerly, by land now or formerly of Mary Ann Clark about one hundred and ten and thirty hundredths (110.30) feet to a point;
Thence westerly, by Austin Street, about forty and sixty-eight hundredths (40.68) fee to the point of beginning.
Said tract contains about 4,545 square feet and is designated on the Assessors’ Plan Book 3, Page 16, as Lot 24.
Also a certain parcel of land with the buildings thereon situated in the City of Worcester, Worcester County, Massachusetts, and described as follows:
BEGINNING on the Southerly side of Austin Street at a corner of land now or formerly of Edwin Ames; thence turning and turning Easterly on said Dewey land 50 feet to a corner of land formerly of Edwin Morse; thence turning and running Northerly on said Morse land 111 feet to said Austing Street; thence Westerly on said Austin Street 50 feet to the point of beginning.
For title see deed recorded with the Worcester County Registry of Deeds in Book 70223, Page 242.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid condominium fees, taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. No representations express or implied are made with respect to any matter concerning the premises, which will be sold “as-is”.
TERMS OF SALE:
Fifty Thousand and 00/100 Dollars ($50,000.00) shall be paid in certified or bank cashier's check by the purchaser at the time and place of said sale, and the balance of the purchase price shall be paid by certified or bank cashier's check at the offices of Erik T. Potter, Esq., Potter MacLellan LLP, 113 Ripley Road, Cohasset, MA 02025 within thirty (30) days from the date of sale. The successful bidder of the sale of the premises shall be required to sign a Memorandum of Terms of Sale containing the above terms at the Auction Sale. The Mortgagee reserves the right to bid at sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
