NOTICE is hereby given that on October 10, 2025, Lake Section Water Company, 303, Paseo Real Drive Chaparral, NM 88081 filed with the STATE ENGINEER Application No. HU-00001-POD16, OSE File No.HU-00001, for Permit to drill an Additional Point of Diversion within the Hueco Underground Water Basin of the State of New Mexico by drilling well HU-00001-POD16 to a depth of 750 feet for 12-inch casing, to be located within the NW ¼ NW ¼ of Section 28, Township 26 South, Range 05 East, NMPM, and more specifically described where Latitude and Longitude intersect at 32° 01' 18.8" N 106° 26' 37.4" W (WGS84), on land owned by Hueco Bolson Realty Inc. to Supplement wells HU-00001 , HU-00001-S through HU-00001-S-8 and HU-00001-POD11 through HU-00001-POD15, for the continued permitted diversion of up to 7,900 acres-feet per annum of water for subdivision, commercial, industrial and related purposes within the Lake Section Water Company service area, as described on file with the State.
Dona Ana is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Las Cruces Sun News.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 1680 Hickory Loop, Suite J, Las Cruces, NM 88005 on or before January 16, 2025. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, at 575-524-6160. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
