AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ROLAND, IOWA, BY AMENDING PROVISIONS PERTAINING TO CITY MANAGER
BE IT ENACTED by the City Council of the City of Roland, Iowa:
SECTION 1. CHAPTER MODIFIED. Chapter 25 of the Code of Ordinances of the City of Roland, Iowa, is repealed and the following adopted in lieu thereof:

25.05 Powers and Duties
25.01 PURPOSE. The purpose of this chapter is to provide for the appointment, powers, and duties of the City Manager.
25.02 APPOINTMENT. The Council shall appoint by majority vote a City Manager to serve at the discretion of the Council.
25.03 COMPENSATION AND BENEFITS. The City Manager shall receive such compensation as established by resolution of the Council and shall also receive all personnel benefits available to other employees of the City.
25.04 ADMINISTRATIVE RESPONSIBILITY. The City Manager shall be directly responsible to the Council for the administration of municipal affairs as directed by that body. All departmental activity requiring the attention of the Council shall be brought before the body by the City Manager and Council involvement in administration initiated by the Council must be coordinated through such officer.
25.06 POWERS AND DUTIES. The City Manager has the following powers and duties:
1. Financial Administration. Be responsible for financial administration and purchasing. Supervise the development and administration of a modern and efficient purchasing system covering the acquisition by the City of services, supplies, and materials.
2. Contracts. Supervise the performance of all contracts of the City, make all purchases of materials and supplies, and see that such materials and supplies are received and are of the quality and character called for by the contract.
3. Property and Improvements. With appropriate professional assistance, supervise the construction, improvement, repair, maintenance, management of all City property, capital improvements and undertakings of the City, including the making and preservation of all surveys, maps, plans, drawings, specifications and estimates for capital improvements, except property, improvements and undertakings managed by a utility board of trustees.
5. Council Meetings. Attend all regular and special meetings of the Council.
6. Investigative Authority. Summarily and without notice, investigate the affairs and conduct of any department, agency, officer, or employee under the supervision of the City Manager, and compel the production and evidence and attendance of witnesses.
7. Planning. Assist the Council, the Planning and Zoning Commission, and all other boards and commissions in the carrying out and revision of the Comprehensive Plan and all other forms of planning for the future growth and development of the City.
8. Economic Development. Execute, oversee, and coordinate the economic development efforts of the City with the County, Ames Regional Economic Alliance, and other local economic development entities.
9. Personnel.
A. Hiring, Supervision, Evaluation, and Termination of Employees. Hire, supervise, terminate, evaluate, or oversee evaluation of the performance of the Public Works Department and temporary seasonal employees. The authority to supervise and evaluate includes but is not limited to suspend, investigate, discipline, and terminate the supervised employees.
10. Recommendations. Recommend to the Council such measures as deemed necessary or expedient for the good government and welfare of the City.
11. City Laws. Supervise the enforcement and execution of the City laws. Investigate all complaints in relation to matters concerning the administration of the government of the City, and see that all franchises, permits, and privileges granted by the City are faithfully observed.
12. Inform and Coordinate. Keep the Council informed on the progress of all its programs and status of its policies; coordinate and direct all municipal services provided through the various departments.
13. Boards and Commissions. Carry on the management of any present board or commission if such board or commission is abolished or ceases to exist.
25.07 OTHER DUTIES. The City Manager shall perform other duties at the Council's direction.
25.08 COUNCIL'S RETAINED POWERS. Without limitation, the Council specifically retains the powers and duties as listed in Chapter 17. In addition, the Council:
1. Controls and directs the activities of the City Manager and Clerk.
2. Makes, establishes, and approves the policies of the City.
25.09 MAYOR'S RETAINED POWERS. Without limitation, the Mayor specifically retains the powers and duties as listed in Chapter 15, provided, however, that the Mayor shall have no retained power with respect to the employees or officers identified in Section 25.06(9) as all supervisory authority has been delegated to the City Manager pursuant to this chapter. In addition, the Mayor:
1. Works with the City Manager in the furtherance of the policies of the Council;
2. Fulfills all legal obligations and responsibilities provided by ordinance or State law.
SECTION 2. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.
