The State of Indiana to the defendants named above and any other person or persons who may be concerned. You are notified that you have been sued in the Court named above. The nature of the suit against you is: Foreclosure of real estate mortgage on: LOTS NUMBERED 18 AND 19 IN ALFRED P. MCCOY'S ADDITION TO THE TOWN (NOW CITY) OF MITCHELL, INDIANA. ALSO, A PART OF THE NORTHWEST QUARTER OF SECTION 6, TOWNSHIP 3 NORTH, RANGE 1 EAST, BOUNDED AS FOLLOWS: BEGINNING AT A POINT ON THE NORTH LINE OF AN ALLEY 10 FEET NORTH FROM THE NORTHWEST CORNER OF LOT 19 IN ALFRED P. MCCOY’S ADDITION TO THE TOWN (NOW CITY) OF MITCHELL, INDIANA; THENCE EAST ALONG THE NORTH LINE OF SAID ALLEY 100 FEET; THENCE NORTH 49 FEET, MORE OR LESS TO THE SOUTH LINE OF A PARCEL OF LAND ONCE OWNED BY JAMES DALTON; THENCE WEST ALONG THE SAID LINE OF SAID PARCEL OF LAND 100 FEET; THENCE SOUTH 49 FEET, MORE OR LESS TO THE PLACE OF BEGINNING. EXCEPTING THEREFROM, THIRTY (30) FEET OF EVEN WIDTH OFF THE EAST END OF LOT NUMBER 18 IN ALFRED P. MCCOY’S ADDITION TO THE TOWN (NOW CITY) OF MITCHELL, INDIANA. ALSO EXCEPTING THEREFROM, THIRTY (30) FEET OF EVEN WIDTH OFF THE EAST END OF THE FOLLOWING DESCRIBED REAL ESTATE, TO-WIT: A PART OF THE NORTHWEST QUARTER OF SECTION 6, TOWNSHIP 3 NORTH, RANGE 1 EAST, BOUNDED AS FOLLOWS: BEGINNING AT A POINT ON THE NORTH LINE OF AN ALLEY 10 FEET NORTH FROM THE NORTHWEST CORNER OF LOT 19 IN ALFRED P. MCCOY’S ADDITION TO THE TOWN (NOW CITY) OF MITCHELL, INDIANA; THENCE EAST ALONG THE NORTH LINE OF SAID ALLEY 100 FEET; THENCE NORTH 49 FEET, MORE OR LESS TO THE SOUTH LINE OF A PARCEL OF LAND ONCE OWNED BY JAMES DALTON; THENCE WEST ALONG THE SAID LINE OF SAID PARCEL OF LAND 100 FEET; THENCE SOUTH 49 FEET, MORE OR LESS TO THE PLACE OF BEGINNING.
This summons by publication is specifically directed to the following named defendant(s) whose whereabouts are known:
Tony Spradlin, and David A. Smith as Personal Representative for the Estate of Donna Chapman and to the following defendant whose whereabouts is unknown: Unknown Heir and Devisees of Donna J. Chapman
In addition to the above named defendants being served by this summons there may be other defendants who have an interest in this lawsuit. If you have a claim for relief against the plaintiff arising from the same transaction or occurrence, you must assert it in your written answer. You must respond to the Complaint in writing, by you or your attorney, within thirty (30) days after the third Notice of Suit is published, and if you fail to do so, a judgment may be entered against you for what the plaintiff has demanded.
