NOTICE OF FORECLOSURE SALE
MONTGOMERY COUNTY, ALABAMA
Default having been made in the payment of the indebtedness secured by that certain mortgage given by Leon J. Wright, Unmarried to Residential Mortgage Corporation, dated February 4, 1998, and recorded in Book 1829 at Page 0969 on February 6, 1998, in the Office of the Judge of Probate of Montgomery County, Alabama, as last transferred to Freedom Mortgage Corporation by assignment, recorded on August 16, 2023, in Book 6021, at Page 549 in the Office of the Judge of Probate of Montgomery County, Alabama, conveying the after-described property to secure a Note in the original principal amount of Fifty-Three Thousand Nine Hundred and 0/100 dollars ($53,900.00), with interest thereon as set forth therein. Brock and Scott, PLLC, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on January 27, 2026, sell at public outcry to the highest bidder for cash at the main courthouse entrance of Montgomery County, Alabama, within the legal hours of sale, the following described property:
Lot 4, Map of Courtland Estates Plat No. 2, Goode Tract, being a Subdivision part of Lot 4, Block C as the same is recorded in Plat Book 8 at page 8 in the office of the Judge of Probate, Montgomery County, Alabama.
The debt secured by said Mortgage has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Mortgage. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Mortgage and by law, including attorney’s fees.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. To the best knowledge and belief of the undersigned, the party in possession of the property is Estate of Leon J. Wright or tenant(s); and said property is more commonly known as 133 Courtland Dr, Montgomery, AL 36105.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the mortgage and (3) any right of redemption or other lien not extinguished by foreclosure.
