MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by David Jon Barboza and Joyce Barboza to New Century Mortgage Corporation, dated October 28, 2004 and recorded in Bristol County (Northern District) Registry of Deeds in Book 14207, Page 314 (the “Mortgage”) of which mortgage Deutsche Bank National Trust Company, as trustee for Morgan Stanley ABS Capital I Inc. Trust 2005-HE2, Mortgage Pass-Through Certificates, Series 2005-HE2 is the present holder by Assignment from New Century Mortgage Corporation to Deutsche Bank National Trust Company, As Trustee dated November 5, 2004 and recorded at said Registry of Deeds in Book 15347, Page 294, and Assignment from Deutsche Bank National Trust Company, As Trustee to Deutsche Bank National Trust Company, as Trustee for Morgan Stanley ABS Capital I Inc. Trust 2005-HE2, Mortgage Pass-Through Certificates, Series 2005-HE2 dated May 20, 2025 and recorded at said Registry of Deeds in Book 29366, Page 305, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 451 Bay Road, South Easton, MA 02375 will be sold at a Public Auction at 2:00 PM on December 16, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:

The land in said Easton, Bristol County, Massachusetts, with the buildings thereon, on the westerly side of Bay Road, containing about 1.073 acres, as shown on a plan of "Land in Easton, Massachusetts owned by Samuel E. Wright, Jr., June 13, 1978, surveyed by I. J. McCann Associates, Inc." recorded at the Bristol Registry of Deeds at Book 1841, Page 294, bounded and described as follows:
BEGINNING at a point in the westerly line of Bay Road, it being Point 2 on said plan, and running thence
NORTH 87 degrees 02' 37" west, 241.56 feet by land of Timothy J. Arsenault, partly by a stone wall to a drill hole in said wall, it being Point #3 on said plan, thence
NORTH 86 degrees 38' 50" west, 0.96 feet by land of said Arsenault to a corner, it being Point #4 on said plan; thence
NORTH 00 degrees 32' 57" west, 184.74 feet to a corner, it being Pont #5 on said plan; thence
NORTH 89 degrees 09' 14" east, 241.50 feet to a corner at the westerly line of Bay Road, it being Point #6 on said plan, thence
SOUTH 01 degree 07' 00" east, 170,67 feet by the westerly line of Bay Road to a point of curvature, it being Point #7 on said plan, thence
BY A CURVE to the right, an arc distance of 30.23 feet on a radius of 988.91 feet, to the point of beginning, it being Point #2 on said plan.
Subject to and with the benefit of rights, restrictions, easements and reservations of record, so far as now in force and applicable.
For mortgagor’s title see deed recorded with the Bristol County (Northern District) Registry of Deeds in Book 11975, Page 259.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
