Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Waymon Colby Oliver and Katie Caruthers Oliver, husband and wife, originally in favor of Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Hometown Lenders, Inc., its successors and assigns, on June 30, 2022, said mortgage recorded in the Office of the Judge of Probate of Tuscaloosa County, Alabama, at Mortgage Book 2022, Page 58741, re-recorded at Mortgage Book 2022, Page 88226, as modified at Mortgage Book 2025, Page 16552; the undersigned Data Mortgage Inc., DBA Essex Mortgage, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash or certified funds, in front of the main entrance of the Courthouse at Tuscaloosa County, Alabama, on January 8, 2026, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Tuscaloosa County, Alabama, to-wit:
All that certain lot or parcel of land situated in the County of Tuscaloosa, State of Alabama, and being more particularly described as follows:
Part of the Southwest Quarter of the Northwest Quarter of Section 24, Township 24 North, Range 3 East, Tuscaloosa County, Alabama, and being more particularly described as follows:
As a Point of Beginning, start at a 1/2 inch iron found and being accepted as the Northeast corner of the Southwest Quarter of the Northwest Quarter of said Section 24; thence run Southwardly and along the East line of said Quarter Quarter 350.00 feet to a 1/2 inch capped rebar set; thence with an interior angle left of 91 degrees 17 minutes run Westwardly 1227.07 feet to a 1/2 inch capped rebar set, said point lying on the East boundary of Lot 14, Shadowood No. 2, as recorded in the Probate Office of Tuscaloosa County, Alabama, in Plat Book 14, at Page 90; thence with an interior angle left of 99 degrees 04 minutes run Northwestwardly and along said East boundary of Lot 14, for a distance of 79.88 feet to a 1/2 inch capped rebar set; thence with an interior angle left of 176 degrees 48 minutes run Northwestwardly and along said East boundary of Lot 14, for a distance of 215.85 feet to a 1/2 inch iron found; thence with an interior angle left of 150 degrees 50 minutes run Northeastwardly and along the East boundary of said Lot 14, for a distance of 93.57 feet to a 1/2 inch iron found, said point lying on the North line of said Quarter Quarter; thence with an interior angle left of 113 degrees 18 minutes run Eastwardly and along said North line 1227.80 feet to the Point of Beginning, thus making a closing interior angle left of 88 degrees 43 minutes. Said parcel containing 10.0 acres, more or less.
And also that certain 30 foot ingress and egress easement described as:
Commence at the Northeast Corner of the Southwest Quarter of the Northwest Quarter of Section 24, Township 24 North, Range 3 East, Tuscaloosa County, Alabama; thence South 03°26'55" West, a distance of 350.00 feet to a iron pin; thence North 87°50'05" West, a distance of 644.62 feet to a point on the Centerline of Easement also the point of beginning of Easement; thence South 52°50'09'' West, a distance of 50.62 feet to a point; thence South 37°29'09" West, a distance of 67.07 feet to a point; thence South 26°16'53” West, a distance of 91.85 feet to a point; thence South 08°55'07” West, a distance of 78.84 feet to a point; thence South 03°46'53" East, a distance of 51.29 feet to a point; thence North 89°58'12” West, a distance of 401.99 feet to the end of traverse. This being a Strip of Land 30 feet in width 15 feet on either side of the Surveyed Line.
