NOTICE OF SALE
UNDER POWER
Because of a default under the terms of the Security Deed executed by Mary E Lanham a/k/a Mary Lanham to Regions Bank dba Regions Mortgage dated December 17, 2024, and recorded in Deed Book 1950, Page 2237, Richmond County Records, securing a Note in the original principal amount of $135,920.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, January 6, 2026, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land with improvements thereon, lying and being in the 1660th District, G.M. of Richmond County, Georgia, fronting on the North side of Tobacco Road a distance of 175 feet, and extending back between parallel lines in a Northerly direction a distance of 115 feet, and being known and designated as Lot No. 3 on a plat prepared by J. E. Crouch, C.E. dated May 12, 1959, and recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia in Book 26R, Page 478. Reference to said plat is made for a more complete and accurate description as to the metes, bounds and location of said property. Bounded as follows: North by lot No. 4, on said plat above referred to; East by property now or formerly of Gibbs: on the South side by Tobacco Road; and on the West by an unnamed street.
Subject to an easement conveyed to the Georgia Power Company, dated December 9, 1941, and recorded in the said Clerks Office in Realty Book 14N at page 206.
This conveyance is made subject to easements and restrictions of record and otherwise affecting the property. Less and Except any Right of Way Deeds affecting the property, including but not limited to, deed recorded in Realty Book 21Q, Page 39.
Said property is known as 3505 Jack Kelly Road, Augusta, GA 30906, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of The Representative of the Estate of Mary E. Lanham, a/k/a Mary Lanham and Jeanette Lanham Moss, successor in interest or tenant(s).
