vs.
ANDREW L. GARCIA and KATHY M. GARCIA, husband and wife; UNKNOWN HEIRS AND DEVISEES OF DEFENDANTS, IF DECEASED, Defendant(s).
UNDER AND BY VIRTUE OF EXECUTION AND ORDER OF SALE issued out of and under the seal of Superior Court of Maricopa County, State of Arizona, on the 17th day of September, 2025, and to me as Sheriff of said County duly directed and delivered in the above entitled action:
WHEREAS, on the 3rd day of January, 2024, the above-named Plaintiff recovered a Judgment in the above-styled Court against the Defendants, Andrew L. Garcia and Kathy M. Garcia, as follows:
The principal amount of $3,981.02 through January 3, 2024, plus accruing quarterly assessments of $147.00 commencing April 1, 2024, or any greater amount assessed by Plaintiff, along with quarterly late fees of $15.00, plus costs taxed and allowed in the amount of $876.46, attorney’s fees in the amount of $1,644.00, accruing interest at the rate of 9.50% per annum, accruing assessments and late fees, and any additional attorney’s fees and court costs incurred in collection of the amounts awarded therein. In addition, an Order Granting Post-Judgment Fees and Costs was signed on April 19, 2024, which awarded $1,662.00 in Post Judgment Attorneys’ fees of $412.44 in Post Judgment Costs. Additional assessments and late fees in the amount of $1,002.00 have been incurred.
THEREFORE, the principal amounts awarded, plus all additional assessments, late charges, interest, attorney’s fees, and costs that have accrued thereafter as awarded in the terms of the above-referenced judgment totals a current balance of $9,574.92 which is now at the date of this Writ due on such judgments, plus interest at the rate of 9.50% per annum. Additional quarterly assessments of $157.00, commencing October 1, 2025, quarterly late fees of $15.00 commencing October 25, 2025, attorney’s fee and costs of the Sheriff’s Sale will continue to accrue and be incurred, and are to be added to the current balance as of the date of the Writ and through the date of the Sheriff’s Sale of the Property, plus costs of Sheriff’s Sale, together with a foreclosure of Plaintiff’s lien against the Defendants, on the following described real property, to-wit:
Lot 115, GRAYSON SQUARE, according to Book 713 of Maps, Page 31; and Affidavit of Correction recorded in Instrument No. 2005-0143622; and in Instrument No. 2005-0143623, records of Maricopa County, Arizona.
AKA: 450 W. Gaby Road, Phoenix, AZ 85041.
NOW, THEREFORE, PUBLIC NOTICE IS HEREBY GIVEN that on the 18th day of December, 2025, at the hour of 10:00 A.M. at 301 West Jefferson Street, Room 250-8*, in the City of Phoenix, Maricopa County, State of Arizona, I will in obedience to said Execution and Order of Sale, sell all the right, title, claim and interest of the above named debtor, in, of and to the above described property at public auction to the highest bidder for cash or certified funds only, in lawful money of the United States, and apply the proceeds thereof to the payment and satisfaction of said judgment, together with the interest that may be due thereon and all costs of suit and accruing costs.
