NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 10/18/2005, SAMUEL F BROWN executed a promissory note payable to the order of WMC MORTGAGE CORP., as Lender,
WHEREAS, the aforesaid promissory note was secured by a Deed of Trust dated 10/18/2005, executed by SAMUEL F BROWN AND WIFE SHANNON C BROWN and being recorded on 10/25/2005 in Book 1978, Page 0969 as Instrument No. 486134 of the records of the Madison County, State of Mississippi; and which aforesaid Instrument conveys to LEM ADAMS III, Trustee and to WMC MORTGAGE CORP., as Lender, Mortgage Electronic Registration Systems, Inc., as Beneficiary, as Beneficiary, the hereinafter described property; and
WHEREAS, Mortgage Electronic Registration Systems, Inc. ("MERS"), solely as nominee for WM? Mortgage Corporation, assigned said Deed of Trust to The Bank of New York Mellon f/k/a The Bank of New York, as Trustee for the Holders of the GE-WMC Asset-Backed Pass-Through Certificates, Series 2005-2 via an instrument filed of record on June 25, 2018 in Book 3615 Page 746 as Instrument No. 841604 in the office of the Clerk of the Madison County, State of Mississippi; and
WHEREAS, THE BANK OF NEW YORK MELLON F/K/A THE BANK OF NEW YORK, AS TRUSTEE FOR THE HOLDERS OF THE GE-WMC ASSET-BACKED PASS-THROUGH CERTIFICATES, SERIES 2005-2 appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC, as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 11/04/2025 and record on 11/06/2025 in Book T-4616, Page 1 as Instrument No 1038232 of the records of the Madison County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said promissory note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc, the Substituted Trustee in said Deed of Trust will on 12/18/2025, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash At South Door, Madison County Courthouse, 128 West North Street, Canton, MS 39046, the following described property located and situated in Madison, Mississippi, to wit:
Lot 65, Ashton Park, Part Two, a subdivision according to the map or plat thereof on file and of record in the office of the Chancery Clerk of Madison County at Canton, Mississippi in Plat Cabinet D at Slide 107, reference to which map or plat is hereby made in aid of and as a part of this description.
More commonly known as: 151 ASHTON PARK BOULEVARD, MADISON, MS 39110
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
