By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Enrique Cruz to Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Home Loans, Inc., its successors and assigns, dated November 8, 2006 and recorded with the Plymouth County Registry of Deeds at Book 33661, Page 244, subsequently assigned to BAC Home Loans Servicing, LP FKA Countrywide Home Loans Servicing, LP by Mortgage Electronic Registration Systems, Inc. by assignment recorded in said Plymouth County Registry of Deeds at Book 39809, Page 273, subsequently assigned to EVERBANK by BANK OF AMERICA, N.A. by assignment recorded in said Plymouth County Registry of Deeds at Book 43618, Page 75, subsequently assigned to GREEN TREE SERVICING LLC by EVERBANK by assignment recorded in said Plymouth County Registry of Deeds at Book 44313, Page 97, subsequently assigned to NEW RESIDENTIAL MORTGAGE LLC, ITS SUCCESSORS AND ASSIGNS by DITECH FINANCIAL LLC F/K/A GREEN TREE SERVICING LLC by assignment recorded in said Plymouth County Registry of Deeds at Book 50933, Page 65, subsequently assigned to U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY, BUT SOLELY AS TRUSTEE OF CITIGROUP MORTGAGE LOAN TRUST 2021-RP4 by NEW RESIDENTIAL MORTGAGE LLC by assignment recorded in said Plymouth County Registry of Deeds at Book 56069, Page 158 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 2:00 PM on December 19, 2025 at 73 Lowell Street, Brockton, MA, all and singular the premises described in said Mortgage, to wit:
The land, together with the buildings and improvements thereon, situated in Brockton, Plymouth County, Massachusetts, being Lot 21 on a plan entitled "Plan of house Lots on Prospect Hill belonging to the Taber heirs, Brockton, 1882, surveyed - resurveyed 1890" which said plan is filed with the Plymouth County Registry of Deeds in Book 1, Page 121 bounded and described as follows:
Beginning at an iron bound in the north line of Lowell Street, which is ninety (90) feet distant from the west line of Cherry; thence
Westerly in the line of said Lowell Street fifty-five (55) feet to an iron bound and lot #20 on a plan of lands below described; thence
Northerly by said Lot #20 one hundred four (104) feet, more or less, to an iron bound and land now or formerly of C.C. Merritt; thence
Easterly by land now or formerly of said Merritt fifty-five (55) feet to an iron bound and land now or formerly of Edward Mason; thence
Southerly by land now or formerly of said Mason and land now or formerly of Mary Hoban one hundred three (103) feet to the point of beginning.
Together with a right of way in common with others over said Lowell Street to and from Warren Avenue and said Cherry Street.
The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
