NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Cheryl L. Dukeman to Fleet National Bank, dated November 17, 2003 and recorded in the Bristol County (Northern District) Registry of Deeds in Book 13325, Page 269, of which mortgage the undersigned is the present holder, by assignment from:
Bank of America, N.A., successor by merger to Fleet National Bank to MEB Loan Trust IV, U.S. Bank National Association, not in its individual capacity but solely as trustee, recorded on November 19, 2019, in Book No. 25526, at Page 126
MEB Loan Trust IV, U.S. Bank National Association, not in its individual capacity but solely as trustee to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust, recorded on April 11, 2024, in Book No. 28812, at Page 1
for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 10:00 AM on December 29, 2025, on the mortgaged premises located at 80 Randall Street, North Easton (Easton), Bristol County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
That certain piece of parcel of land, and the buildings and improvements thereon,
In the Town of North Easton
County of Bristol
and State of Massachusetts
and being more particularly described in a deed recorded in book 7501 page 88. Said description:
A certain parcel of land with building thereon in Easton, Bristol County, Massachusetts situated on the southwesterly side of Randall Street, being shown as Lot 2 on a plan entitled "Plan of Land in Easton, Mass,", dated May 23, 1979, by Ernest W. Branch, Inc., Civil Engineers which plan is recorded with Bristol County, Northern District Registry of Deeds in Plan Book 178, Page 70. Said Lot 2 is bounded and described as follows:
NORTHEASTERLY by Randall Street by two courses measuring 122.09 feet and 27.91 feet, respectively;
SOUTHEASTERLY by Lot 3 as shown on said plan, 275.51 feet;
SOUTHWESTERLY by Lot 4 as shown on said plan, 150.00 feet; and
NORTHWESTERLY by Lot 1 as shown on said plan, 270.00 feet.
Said Lot 2 contains 40,493 square feet of land according to said plan.
For mortgagor's(s') title see deed recorded with Bristol County (Northern District) Registry of Deeds in Book 7501, Page 88.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Fifteen Thousand ($15,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
