SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, on November 11, 1999, Dillard Wayne Lewis, Jr. and Marilee Shayne Lewis executed a Deed of Trust to James Kearney Travis, III, Trustee, to secure Equity Financial Services, Inc., which Deed of Trust is recorded in Book 1071 at Page 152 in the records in the office of the Chancery Clerk of Forrest County, Mississippi; and,
WHEREAS, said Deed of Trust was assigned to Community Bank of Desoto County by Equity Financial Services LLC, successor to Equity Financial Services, Inc., by Assignment dated April 17, 2001 and recorded in Book 1139 Page 146 in the office of the Chancery Clerk of Forrest County, Mississippi; and,
WHEREAS, said Deed of Trust was assigned to Equity Financial Services, LLC by Community Bank, North Mississippi, formerly Community Bank of Desoto County, by Assignment dated February 3, 2014, recorded in Book 1944 Page 746 in the office of the Chancery Clerk of Forrest County, Mississippi; and
WHEREAS, by Substitution of Trustee dated November 7, 2025, and recorded in Book 2607 at Page 195 in the records in the office of the Chancery Clerk of Forrest County, Mississippi, Equity Financial Services, LLC did substitute Don A. McGraw, Jr., as Trustee, in the place of and instead of James Kearney Travis, III; and,
WHEREAS, default having been made in the performance of the conditions and stipulations as set forth in said Deed of Trust and having been requested to do so by Equity Financial Services, LLC, the legal holder of the indebtedness secured and described by said Deed of Trust, notice is hereby given that I, Don A. McGraw, Jr., Substituted Trustee, by virtue of the authority conferred upon me in said Deed of Trust, will offer for sale and will sell at public sale and outcry to the highest and best bidder, for cash, during legal hours, being between the hours of 11:00 o'clock a.m. and 4:00 o'clock p.m., at the northeast main entrance (back door) of the Paul B. Johnson, Jr. Chancery Building, located at 641 Main Street, Hattiesburg, Mississippi, on the 23rd day of January, 2026, the following described land and property, being the same land and property described in said Deed of Trust, and being situated in Forrest County, Mississippi, to-wit:
A part of the Northeast Quarter of the Northeast Quarter of Section 26, Township 3 North, Range 13 West, Forrest County, Mississippi, and being more particularly described as follows:
Commence at a 6 inch corner post marking the Northeast corner of said Section 26, thence West 856.34 feet to a /2 inch rebar thence South 32 degrees 45 minutes 55 seconds West 484.56 feet to a 1/2 inch rebar, the Point of Beginning, thence South 46 degrees 11 minutes 39 seconds East 384.14 feet to a 1/2 inch rebar, thence South 36 degrees 23 minutes 11 seconds West 200.00 feet to an iron spike in the center of a 40 foot right-of-way, thence along the centerline of said right-of-way on the following courses: North 53 degrees 36 minutes 49 seconds West 149.44 feet, thence North 50 degrees 20 minutes 57 seconds West 129.98 feet, thence North 38 degrees 16 minutes 06 seconds West 65.03 feet, thence North 22 degrees 41 minutes 47 seconds West 30.00 feet to an iron spike, thence North 32 degrees 45 minutes 55 seconds East 210.00 feet to the Point of Beginning, containing 1.868 acres more or less, in the above said Section, Township, and Range.
Together with that certain perpetual non-exclusive easement and right-of-way forty (40) feet in width for purposes of ingress and egress and for utilities, described in Easement instrument dated January 14, 1999, of record in Land Deed Book 809 at Page 338, the said perpetual non-exclusive road easement and right-of-way being more particularly described as follows, to-wit:

Title to said property is believed to be good, but I will only convey such title as is vested in me as Substituted Trustee.
