The Citation prays that the property legally described as: S 35 FT LOT 3 FAIRFIELD, and locally known as 322 SE 33rd Street, Des Moines, Iowa, is in violation with the Municipal Code of the City of Des Moines, Section 135-6.8.6.A by allowing vehicles to be parked on unapproved surfaces (grass, soil and/or gravel). Further, Plaintiff prays: The Court order the Defendant to permanently cease parking vehicles on unapproved surfaces; permanently remove gravel from the property and right-of-way; return to grass the disturbed areas throughout the property and right-of-way and schedule an inspection upon completion of all listed remedial action. Further, the Plaintiff requests that if the property is not abated in the time ordered by the court, the Plaintiff be authorized to enter upon the property and fenced area (if applicable) and abate the violations. Further, the Plaintiff requests that the court assess in rem against the property for the costs of this action and the costs incurred in the enforcement of the Municipal Code of the City of Des Moines, Iowa, inclusive of all fines and civil penalties incurred, all with interest.
