NOTICE OF SALE UNDER POWER
GEORGIA, JEFFERSON COUNTY
Under and by virtue of the power of sale contained in a Deed to Secure Debt, dated April 23, 2021, and recorded in Book 613, Pages 427-431, in Jefferson County, Georgia records, from Melissa N. Wilcher, to Otis Franklin Askin, Jr. and Kristin Askin Hutto as Co-Trustees as shown in the Memorandum of Trust dated 11/22/11 created under the Last Will and Testament of Otis Franklin Askin, Sr. dated 11/22/11 and recorded in Jefferson County, Georgia in Book 572, Pages 650-674 , said Deed to Secure Debt having been given to secure a note dated April 23, 2021, in the original principal sum of Six Thousand Two Hundred Fifty and 00/100 ($6,250.00) Dollars with interest from date at the rate stated in said note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Jefferson County, Georgia within the legal hours of sale on the first Tuesday in January, 2026, the property described in said Deed to Secure Debt, to wit:
All that lot or parcel of land, situate, lying, and being in the 81st G.M.D., Jefferson County, Georgia, and being known and designated as Lot 6, Section I, Sam’s Landing Subdivision, containing 1.34 acres, more or less, as shown upon a plat thereof recorded in the Office of the Superior Court Clerk for Jefferson County, Georgia in Plat Book 3, Page 156; reference being made to said plat for a more complete and accurate description of said property. Jefferson County has not yet issued an address for this property.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, the non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including legal fees.
This sale will be held subject to all unpaid taxes, assessments, and restrictions of record, if any, transfer tax and all state and county taxes.
Said property will be sold as the property of Melissa N. Wilcher, the property to the best information, knowledge, and belief of the undersigned, being presently in the possession of Melissa N. Wilcher, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney’s fees, all as provided in said deed, and the balance, if any, will be distributed as provided by law.
Terms of the sale are to be cash, purchaser paying for papers, revenue stamps, and all state and county taxes.
