By virtue and in execution of the Power of Sale contained in a certain mortgage given by Rose Jaquith to Sovereign Bank, N.A., dated March 13, 2012 and recorded in the Barnstable County Registry of Deeds in Book 26217, Page 304, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 10:00 AM on January 13, 2026, on the mortgaged premises located at 4 Andrew Road, Sagamore Beach (Bourne), Barnstable County, Massachusetts, all and singular the premises described in said mortgage,
TO WIT:
THE LAND IN BOURNE (SAGAMORE), BARNSTABLE COUNTY, MASSACHUSETTS, BEING SHOWN AS LOT 2 ON A PLAN OF LAND ENTITLED "DEFINITIVE PLAN, BOURNE, MA., SUBDIVISION OF LAND-MEADOW WOOD ESTATES, SECTION 3, OWNED BY ANDREW B. SIMSKI, ET AL, BOURNE, MA, HOS ENGR. ASSOCIATES, INC., 622 MAIN ST., RAYNHAM, MA SCALE 1 INCH= 40 FEET, MAR. 17, 1987," WHICH SAID PLAN IS DULY RECORDED WITH THE BARNSTABLE COUNTY REGISTRY OF DEEDS IN PLAN BOOK 434, PAGE 84, AND TO WHICH SAID PLAN REFERENCE IS HEREIN MADE FOR A MORE PARTICULAR DESCRIPTION THEREOF.
CONTAINING 21,320 SQUARE FEET OF LAND, MORE OR LESS, ACCORDING TO SAID PLAN.
FOR OUR TITLE SEE DEED OF ANDREW B. SIMSKI, TRUSTEE OF SIMSKI FAMILY TRUST DATED NOVEMBER 11, 1987, RECORDED WITH BARNSTABLE COUNTY REGISTRY OF DEEDS IN BOOK 6025, PAGE 29.
SUBJECT TO RESTRICTIONS, RESERVATIONS, EASEMENTS, COVENANTS, OIL, GAS OR MINERAL RIGHTS OF RECORD, IF ANY.
For mortgagor's(s') title see deed recorded with Barnstable County Registry of Deeds in Book 7004, Page 247.
These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of Fifteen Thousand ($15,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale.
