CIVIL ACTION, SUMMONS FOR DIVORCE
From the State of New Jersey, to the Defendant Named Above:
The plaintiff, named above, has filed a complaint for divorce against you in the Superior Court of New Jersey, Morris County. The complaint for divorce attached to this summons states the basis for this complaint. If you dispute this complaint, you or your attorney must file an answer within 35 days after you received this Summons, not counting the date you received it. The cost to file an answer is $175 (plus an additional Parent Education Seminar fee of $25.00, if child support, custody or parenting time is a relief requested by either you or the plaintiff). If an active Domestic Violence Restraining order exists between you and the plaintiff, you are exempt from the Parent Education Seminar and a fee is not required.
If you fail to file and serve an answer within 35 days, a judgment by default may be rendered against you for the relief demanded in the complaint. You shall promptly file your answer or general appearance and proof of serve thereof, in person or by mail to the Superior Court of New Jersey, Chancery Division-Family Part, Morris County. You must also send a copy of your written answer to the plaintiff or attorney indicated above.

COMPLAINT FOR DIVORCE
18 Month Separation
The Plaintiff, Roberto Enrique Cespedes, residing at 90 West Blackwell Street, in the town of Dover, County of Morris, and State of New Jersey, by way of Complaint says:
FIRST: Plaintiff was lawfully married to Defendant Virgen Maisonet Rosa (D.O.B. 03/11/1962) on October 6th of 1996 in a civil ceremony, in the City of San Juan, Puerto Rico.
SECOND: Plaintiff was a bona fide resident of the State of New Jersey when this cause of action arose and has ever since and for more than one (1) year next proceeding the commencement of this action continued to be such a bona fide resident.
THIRD: The defendant now resides at the following address: 130 West Blackwell Street Dover, NJ 07801.
FOURTH: The parties separated on or about December 2005 ever since which time the parties have lived separate and apart from each other; Plaintiff resided at 130 West Blackwell Street Dover, NJ 07801, and Defendant resided at 130 West Blackwell Street Dover, NJ 07801. This separation has continued to the present and no reasonable prospect of reconciliation exists.
FIFTH: At the expiration of 18 months of such separation, Plaintiff resided at 130 West Blackwell Street Dover, NJ 07801, and was a resident there at the time the cause of action for divorce when the grounds of separation arose.
SIXTH: There were no children born of this marriage.
SEVENTH: There was no real or personal property acquired during the course of this marriage.
EIGHTH: There have been no previous proceedings between the Plaintiff and the Defendant respecting the marriage or its dissolution.
WHEREFORE, the Plaintiff demands judgment:
a) Dissolving the marriage between the parties.
b) That no equitable distribution is sought.
c) For such other relief as the Court may deem equitable and just.
