NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 09/21/1993, THERMAN L HOWARD JR AND WIFE, JENNIE B HOWARD executed a promissory note payable to the order of COMMUNITY MORTGAGE CORPORATION.
WHEREAS, the aforesaid promissory note was secured by a Deed of Trust dated 09/21/1993, executed by THERMAN L HOWARD JR AND WIFE, JENNIE B HOWARD and being recorded on 09/24/1993 in Book 847, Page 129 as Document No. 122136 of the records of the Madison County, State of Mississippi; and which aforesaid Instrument conveys to L PATRICK SANDLIN, Trustee and to COMMUNITY MORTGAGE CORPORATION, as Beneficiary, the hereinafter described property; and
WHEREAS, THE BANK OF NEW YORK MELLON TRUST COMPANY, N.A., F/K/A THE BANK OF NEW YORK TRUST COMPANY, NA, AS SUCCESSOR-IN-INTEREST TO JPMORGAN CHASE BANK, NATIONAL ASSOCIATION F/K/A JPMORGAN CHASE BANK, AS TRUSTEE FOR REGISTERED HOLDERS OF SALOMON BROTHERS MORTGAGE SECURITIES VII, INC., MORTGAGE PASS THROUGH CERTIFICATES, SERIES 2001-2 assigned said Deed of Trust to The Bank of New York Mellon Trust Company, N.A., as successor-in-interest to all permitted successors and assigns of JPMorgan Chase Bank, as Trustee for registered holders of Salomon Brothers Mortgage Securities VII, Inc., Mortgage Pass Through Certificates, Series 2001-2 via an instrument filed of record on March 11, 2024 as Document No. 1000354, in Book T-4418, and at Page 47 in the office of the Clerk of the Madison County, State of Mississippi; and
WHEREAS, THE BANK OF NEW YORK MELLON TRUST COMPANY, N.A., AS SUCCESSOR-IN-INTEREST TO ALL PERMITTED SUCCESSORS AND ASSIGNS OF JPMORGAN CHASE BANK, AS TRUSTEE FOR REGISTERED HOLDERS OF SALOMON BROTHERS MORTGAGE SECURITIES VII, INC., MORTGAGE PASS THROUGH CERTIFICATES, SERIES 2001-2 appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC, as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 11/19/2025 and recorded on 11/21/2025 in Book T-4620, Page 872 as Instrument No. 1039038 of the records of the Madison County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said promissory note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc, the Substituted Trustee in said Deed of Trust will on 01/08/2026, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the South Door of the Madison County Courthouse, 128 West North Street, Canton, MS 39046, the following described property located and situated in Madison, Mississippi, to wit:
LOT 99 LAKELAND ESTATES SUBDIVISION. PART II, a subdivision according to the map or plat thereof on file and of record in the office of the Chancery Clerk of Madison County at Canton, Mississippi in Plat Cabinet A at slide 115 thereof, reference to which map or plat is hereby made in aid of and as a part of this description
More commonly known as: 690 RALDE CIRCLE, RIDGELAND, MS 39157
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
