Under and by virtue of a power of sale contained in the Purchase Money Deed of Trust from The Cumberland Valley Chapter Associated Builders and Contractors, Inc., to First United Bank & Trust dated December 19, 2018, and recorded in Liber 5896, folio 162, among the Land Records of Washington County, Maryland, and duly assigned to me for the purpose of foreclosure, default having been made under the agreements, covenants and conditions of said Deed of Trust, the undersigned will offer for sale at public auction outside on the front steps of the Washington County Circuit Courthouse, Hagerstown, Maryland on

ALL that lot or parcel of land situate Southwest of and parallel to Wayside Avenue between City Alleys 4-29 and 4-31 in the City of Hagerstown, Maryland and being more particularly described in accordance with a survey by Frederick, Seibert and Associates dated March 14, 2007, as follows:
BEGINNING for the outline hereof at mag nail set in the Northwest margin of City Alley 4-29, said point being 140 feet Southwest of its intersection with the Southwest margin of Wayside Avenue as measured along the Northwest margin of said alley, running thence with the Northeast margin of alley 4-29, South 43° 50' 03" West 22.00 feet to a mag nail set, thence leaving the City Alley 4-29 and running with the Southwestern margin of the 12 foot alley shown on "Armstrong's Allotment of Part of Harris's Wayside Addition to Hagerstown" as recorded in Liber 89, folio 308, North 44° 58' 24" West 147.84 feet to a mag nail set, thence with City Alley 4-31 North 43° 04' 20" East 20.00 feet to a mag nail set, running thence with Lots 5 thru 9 of "Armstrong's Allotment", South 1° 55' 40" East 11.70 feet to a mag nail set thence South 44° 58' 24" East 128.97 feet to a point, thence South 88° 26' 22" East 14.53 feet to the place of beginning;

SAID lands being all that portion of a 12 foot alley lying Southwest of Lots 5-9 as shown on "Armstrong's Allotment or Part of Harris's Wayside Addition to Hagerstown" recorded at Liber 89, folio 308 among the Land Records of Washington County, Maryland.

ALL the following described five parcels of land, together with all the improvements thereon, and all right, ways, privileges and appurtenances thereunto belonging or in anywise appertaining, situate in Election District 22, on the East side of Locust Street extended in Harris's Addition to Hagerstown and on the South side of Wayside Avenue within the City of Hagerstown, Washington County, Maryland, and described as follows:
PARCEL NO. 1: BEGINNING at the end of 162 feet from the North margin of Broadway Avenue at its intersection with Locust Street extended and running thence North with the East margin of said Locust Street extended, 176 feet 9 inches, thence East 307 feet and 8 inches to an alley, thence South with the West margin of said alley 170 feet 9 inches to a point 162 feet from the said North margin of Broadway Avenue, thence West 306 feet 6 inches to the place of beginning; containing 1 and ¼ acres of land, more or less.
PARCEL NO.2: ALL of the following described lots of land situated on the South side of Wayside Avenue, each of said lots having a frontage thereon of thirty (30) feet and extending back therefrom in a Southerly direction with that uniform width one hundred and fifty (150) feet, more or less, to an alley, being designated respectively as Lots Numbers six and seven on the plat of land called "Armstrong's Allotment of part of Harris's Wayside Addition to Hagerstown" as recorded in Liber 89, folio 308.
PARCEL NO. 3: ALL of the following described lot of land situated on the South side of Wayside Avenue, having a frontage on said Avenue of thirty (30) feet and running back with a uniform width one hundred and fifty (150) feet, more or less, to an alley, being Lot Number nine on a plat of lots called "Armstrong's Allotment of part of Harris's Wayside Addition to Hagerstown" recorded in Liber 89, folio 308, one of the Land Records of Washington County (this lot of land is subject to a building line as shown by the aforesaid Plat and also subject to a cut off in the Southeast corner thereof for alley purposes, as shown upon said Plat).
PARCEL NO.4: ALL of the following described lot of the land situated on the South side of Wayside Avenue, being all that lot of land having a frontage on said Avenue of thirty feet (30) feet and running back with a uniform width one hundred and fifty (150) feet to an alley, being all that lot of land number eight (8) on a plat of lots called " Armstrong's Allotment of part of Harris's Wayside Addition to Hagerstown" recorded in Liber 89, folio 308, one of the Land Records of Washington County, Maryland. Subject to a building line now established and shown on the Plat aforesaid.
PARCEL NO. 5: ALL of the following described lot of land situated on the South side of Wayside Avenue, having a frontage on said Avenue of thirty (30) feet running back with that uniform width one hundred fifty (150) feet to an alley, being Lot Number Five on a Plat of lots called "Armstrong's Allotment of part of Harris's Wayside Addition to Hagerstown" recorded in Liber 89, folio 308, one of the Land Records of Washington County. Subject to a building line as established on the Plat aforesaid and being subject to a cut off at the Southwest corner thereof for alley purposes, as shown on the Plat aforesaid.
IT BENG the same property conveyed unto Cumberland Valley Chapter Associated Builders and Contractors, Inc. by Quitclaim Deed from City of Hagerstown dated December 11, 2007, and recorded in Liber 3430, folio 416, among the Land Records of Washington County, Maryland.
TERMS OF SALE: A cash deposit or certified check made payable to GMPG of $10,000.00 shall be paid at the time and place of sale, except no deposit shall be required of the Mortgagee, its successors or assigns, balance in cash at settlement, except that if the mortgagee, its successors or assigns is the purchaser, a credit will be allowed for the mortgage debt, which shall be twenty (20) days after final ratification of sale by the Circuit Court for Washington County unless said period is extended by the Substitute Trustee, his successors or assigns, for good cause shown, time being of the essence; interest at the rate of 3.25% per annum shall be paid on unpaid purchase money from date of sale to date of settlement. The property will be sold subject to all restrictions, liens, covenants and encumbrances of record. In the event that the purchaser fails to go to settlement as required, the property shall be re-sold at purchaser's risk and expense. Taxes, water, rent, and all other municipal liens and charges to be adjusted to date of sale. All other public charges and assessments payable on an annual basis shall be adjusted to date of sale and assumed thereafter by the purchaser. Cost of all documentary stamps, transfer taxes, document preparation and title insurance shall be borne by purchaser.
The improvements are being sold in an "as is" condition with purchaser responsible for any and all housing or zoning code violations.
