MORTGAGEE'S SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by 64 Kendall Road Holden LLC to Steven A. Ross, Trustee of QS Lending Three Trust, dated November 15, 2022 and recorded on November 2025 with the Worcester County Registry of Deeds in Book 68488, Page 153 of which mortgage the undersigned is the present holder, and in which the mortgaged premises consists a certain parcel of land with the buildings and improvements thereon located in Holden known as 64 Kendall Road, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on the 14th day of January 2026 at 11:00AM, at the mortgaged premises located at 64 Kendall Road, Holden, Massachusetts, all and singular the premises described in said mortgage.
To wit:
A certain parcel of land with the buildings thereon, situated in the Town of Holden, Massachusetts and bounded and described as follows:
BEGINNING in the northwesterly corner of the granted premises, at a point in the southeasterly line of a right of way leading to Kendall Road, at an iron pip sunk in the ground by land now or formerly leading to Kendall Road, at an iron pipe sunk in the ground by land now or formerly of Carl J. Bryngelson and Ivan J. Lundquist;
THENCE by said right of way, North 46°59’30” East a distance of one hundred and seventy-five (175) feet to an iron pipe sunk in the ground;
THENCE by land now or formerly of said Bryngelson et al, South 43°00’30” East a distance of three hundred (300) feet to an iron pip sunk in the ground;
THENCE by land now or formerly of said Bryngelson et al, South 46°59’30” West a distance of one hundred seventy-five (175) feet to an iron pipe sunk in the ground;
THENCE by land now or formerly of said Bryngelson et al, North 43°00’30” West a distance of three hundred (300) feet to the place beginning.
The parcel containing a calculated area of 52,500 square feet of land and being the same premises shown on a “Plan of Land in Holden, Massachusetts”, dated June 12, 1958 and made by Gosta R. Truedsson, C.E.”
Granting also the right to pass and repass over a right of way located on the land of the said Byrngelson et al and leading to Kendall Road, being more particularly described as follows:
Beginning at a point in the center line of said right away, at the southeasterly line of Kendall Road and where said right of way now runs by land now or formerly of one Brown;
THENCE South 43°00’30” East a distance of three hundred twelve (312) feet, more or less, to a point;
THENCE North 46°59’30” East a distance of three hundred eighty (380) feet to a point; the said right of way being forty (40) feet wide and the above-described courses being in the center of the road.
The said right of way is also shown on the plan referred to above.

Said premises are conveyed together with the right to use the wall on the other land of said Bryngelson et al and the right to convey the water by pipes from said well as they now exist, until such time as Town Water shall be available, the said Herbert H. Lundquist and Mae E. Lundquist, their heirs and assigns, to pay $10.00 a year for said use, it being understood that said use is to reasonable and for the usual domestic purposes incidental to the conveyed premises as now existing and it being further understood that the grantee, her heirs and assigns agree to maintain and repair said well, water system and pipes after such time as the herein grantor, his heirs and assigns cease to draw from the aforesaid well and before Town Water is available to the Grantee, her heirs and assigns.

Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid condominium fees, taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. No representations express or implied are made with respect to any matter concerning the premises, which will be sold “as-is”.
TERMS OF SALE:
Twenty-Five Thousand and 00/100 Dollars ($25,000.00) shall be paid in certified or bank cashier's check by the purchaser at the time and place of said sale, and the balance of the purchase price shall be paid by certified or bank cashier's check at the offices of Erik T. Potter, Esq., Potter MacLellan LLP, 113 Ripley Road, Cohasset, MA 02025 within thirty (30) days from the date of sale. The successful bidder(s) of the premises shall be required to sign a Memorandum of Terms of Sale containing the above terms at the Auction Sale. The Mortgagee reserves the right to bid, to reject any and all bids, to continue and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication.
