SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE
WHEREAS on March 12, 2001, FRANKLIN L. MALLETT, HUSBAND AND TRACY MALLETT, WIFE AKA TRACY R. MALLETT, executed a Deed of Trust to W. STEWART ROBISON, as Trustee, and JIM WALTER HOMES, INC., as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Hinds (First Judicial District) County, Mississippi, in Book 367, Page 787 – and as Instrument Number 121082; and
WHEREAS, Jim Walter Homes, Inc assigned said Deed of Trust to U.S. BANK, N.A., AS TRUSTEE, SUCCESSOR IN INTEREST TO WACHOVIA BANK, NATIONAL ASSOCIATION, AS TRUSTEE, SUCCESSOR BY MERGER TO FIRST UNION NATIONAL BANK AS TRUSTEE, FOR MID-STATE TRUST X via an instrument filed October 04, 2023 and recorded in Book 647, Page 1726 – and as Instrument No. 277959 – in the Office of the Chancery Clerk of Hinds County, Mississippi; and
WHEREAS, the subject Deed of Trust and the underlying Note were modified via an instrument filed January 07, 2025, and recorded in Book 7318, Page 3120 in the office of the Chancery Clerk of Hinds County, Mississippi, First Judicial District; and
WHEREAS, U.S. BANK, N.A., AS TRUSTEE, SUCCESSOR IN INTEREST TO WACHOVIA BANK, NATIONAL ASSOCIATION, AS TRUSTEE, SUCCESSOR BY MERGER TO FIRST UNION NATIONAL BANK AS TRUSTEE, FOR MID-STATE TRUST X appointed Padgett Law Group as Substitute Trustee via an instrument dated September 26, 2025 and recorded in Book 649, Page 3677 – and as Instrument No. 286463 – in the Office of the Chancery Clerk of Hinds County, Mississippi; and
WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and U.S. BANK, N.A., AS TRUSTEE, SUCCESSOR IN INTEREST TO WACHOVIA BANK, NATIONAL ASSOCIATION, AS TRUSTEE, SUCCESSOR BY MERGER TO FIRST UNION NATIONAL BANK AS TRUSTEE, FOR MID-STATE TRUST X, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor.
THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the main door of the Hinds (First Judicial District) County Courthouse, at Jackson, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on January 23, 2026, to satisfy the indebtedness now due under and secured by said deed(s) of trust.
Padgett Law Group will convey only such title as vested in it as Substituted Trustee.

A CERTAIN PARCEL OF LAND LYING AND BEING SITUATED IN THE EAST HALF OF SOUTHEAST QUARTER OF SECTION 22, TOWNSHIP 4 NORTH, RANGE 4 WEST, HINDS COUNTY, MISSISSIPPI, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGIN AT THE INTERSECTION OF THE WEST SIDE OF THE EAST HALF OF THE SOUTHEAST QUARTER AND THE SOUTHEAST SIDE OF ERNIE MARTIN ROAD AND RUN NORTH 40 DEGREES EAST ALONG THE SOUTHEAST SIDE OF ERNIE MARTIN ROAD FOR 210 FEET; THENCE RUN SOUTH 30 DEGREES EAST FOR 420 FEET, THENCE RUN SOUTH 40 DEGREES WEST FOR 210 FET; THENCE RUN NORTH 50 DEGREES WEST FOR 420 FEET TO THE POINT OF BEGINNING, CONTAINING (2) TWO ACRES, MORE OR LESS.
The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
