NOTICE OF FORECLOSURE SALE
ETOWAH COUNTY, ALABAMA
Default having been made in the payment of the indebtedness secured by that certain mortgage given by Jerry Abercrombie, III , A Married Man and wife, Kristine Baker to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for AmeriSave Mortgage Corporation, dated March 22, 2022, and recorded at Instrument # 3537536 on March 23, 2022, in the Office of the Judge of Probate of Etowah County, Alabama, as last transferred to AmeriSave Mortgage Corporation by assignment, recorded on June 13, 2023, Instrument Number 3559159 in the Office of the Judge of Probate of Etowah County, Alabama, conveying the after-described property to secure a Note in the original principal amount of One Hundred Eighty-Five Thousand and 0/100 dollars ($185,000.00), with interest thereon as set forth therein. Brock and Scott, PLLC, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on February 11, 2026, sell at public outcry to the highest bidder for cash at the main courthouse entrance of Etowah County, Alabama, within the legal hours of sale, the following described property:
A parcel of land situated in Lot 10 of Fractional Section 9, Township 11 South, Range 5 West, Etowah County, Alabama, being more particularly described as follows:
BEGIN at a 1" square post at the NE corner of Lot 10 of Fractional Section 9, Township 11 South, Range 5 West, Etowah County, Alabama; thence N 88°49'47" W along the north line of said Lot 10 a distance of 36.01 feet to a 1" open pipe; thence N 88°58'20" W along said north line a distance of 126.63 feet to a 1" open pipe; thence N 89°13'53" W along said north line a distance of 191.08 feet to a 1" open pipe; thence N 88°58'38" W along said north line a distance of 79.22 feet to a axle; thence S 03°09'06" W leaving said north line a distance of 206.46 feet to a 1" open pipe; thence S 47°50'28" E a distance of 288.43 feet to a 1/2" rebar capped EDG on the northwesterly right of way of Mountain View Drive, said point also being a point on a non-tangent curve to the right having a central angle of 57°33'19" and a radius of 239.73 feet, said curve subtended by a chord bearing N 63°16'28" E and a chord distance of 230.82 feet; thence along the arc of said curve and along said right of way a distance of 240.82 feet to a 1/2" rebar capped EDG; thence S 87°56'52" E along said right of way a distance of 33.27 feet to a 1/2" rebar capped EDG on the west line of said Lot 10; thence N 01°46'18" W along said west line a distance of 290.29 feet to the POINT OF BEGINNING. Said parcel of land contains 3.16 acres, more or less.
The debt secured by said Mortgage has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Mortgage. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Mortgage and by law, including attorney’s fees.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

To the best knowledge and belief of the undersigned, the party in possession of the property is Estate of Jerry Abercrombie III and Kristine Baker or tenant(s); and said property is more commonly known as 565 Mountain View Drive, Attalla, AL 35954.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the mortgage and (3) any right of redemption or other lien not extinguished by foreclosure.
