ORDER
This matter came before the Court on December 4, 2025, on the Plaintiff’s Motion for Alternative Service pursuant to Rule 4(e) of the Rhode Island Superior Court Rules of Civil Procedure. After reviewing the Motion, the supporting affidavit of the private investigator, and the record of diligent but unsuccessful attempts to locate and personally serve Defendant Plinio J. Javier Peguero, the Court finds:
1. Plaintiff has exercised due diligence in attempting to ascertain the current residence, whereabouts, or valid address of Defendant.
2. All reasonable efforts to effectuate personal service have been exhausted.
3. Further attempts at personal service would be futile.
4. Good cause exists to authorize alternative service pursuant to Rule 4(e).
Accordingly, Plaintiff’s Motion for Alternative Service is hereby GRANTED, and it is
ORDERED, ADJUDGED and DECREED
as follows:
1. Service by Publication. Plaintiff is authorized and directed to serve Defendant Plinio J. Javier Peguero by publication in a newspaper of general circulation in Providence County. Publication shall run once per week for three (3) consecutive weeks, contain the case caption and a statement that the Complaint has been filed, and direct Defendant to respond within twenty (20) days of final publication.
2. Tack-On Service. In addition to publication, Plaintiff is authorized to effect tack-on service by affixing a true and attested copy of the Summons, Complaint, and this Order to the front door or most accessible entrance of Defendant’s last known address: 36 Erastus Street, Providence, Rhode Island 02909. Service is deemed complete upon affixing.
3. Effect of Service. Service shall be deemed complete upon the later of the final publication date or the date the documents are affixed at the last known address.
