MORTGAGEE'S SALE OF REAL ESTATE
By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Richard L. Davidson to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Envision Bank, its successors and assigns, dated November 18, 2019 and recorded in Worcester County (Worcester District) Registry of Deeds in Book 61467, Page 24 (the “Mortgage”) of which mortgage Selene Finance, LP is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Envision Bank, its successors and assigns to JPMorgan Chase Bank, National Association dated April 17, 2024 and recorded at said Registry of Deeds in Book 70466, Page 64, and Assignment from JPMorgan Chase Bank, National Association to Selene Finance LP dated November 15, 2024 and recorded at said Registry of Deeds in Book 71322, Page 326, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 29 Cleveland Street, Gardner, MA 01440 will be sold at a Public Auction at 11:00 AM on April 28, 2026, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:
Parcel 1:
A certain parcel of land, with the buildings and other improvements thereon, situated on the easterly side of Summer Street in Gardner, Worcester County, Massachusetts, bounded and described as follows:
Beginning at the southwesterly corner of the land and at the southeasterly corner of land now or formerly of Julius Johnson; thence
N 63/4° E by land now or formerly of Julius Johnson, 119.7 feet to a corner; thence N 89 1/2° E by land now or formerly of Edward P. Masse Land co., 49.2 feet to a corner; thence S 3° E to a point by land now or formerly of Edward Rogers and Alice P. Rogers, 76.9 feet; thence S 6 3/4° W by land now or formerly of Edward Rogers and Alice P. Rogers and others, 49.0 feet to a corner; thence N 83 1/4° W, by land now or formerly of Blanche E. Smith et als, 62.0 feet to the place of beginning.
Parcel 2:
Certain lots of land, with the buildings and other improvements thereon, situated in Gardner, Worcester County, Massachusetts numbered 104, 105, 106, 107 and 108 on a plan of "Gardner View" made by Gates & Ray, E.E., dated October, 1911 and recorded in Worcester District Registry of Deeds, Plan Book 23, Plan 2.
For mortgagor’s title see deed recorded with the Worcester County (Worcester District) Registry of Deeds in Book 20588, Page 393.
The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
