NOTICE OF PUBLIC HEARING BOROUGH OF BERNARDSVILLE ZONING BOARD OF ADJUSTMENT PLEASE TAKE NOTICE that on Monday, May 4, 2026, at 7:30 P.M., in the Borough of Bernardsville Council Chambers at the Borough Hall, 166 Mine Brook Road, 2nd Floor, Bernardsville, New Jersey, 07924, the Zoning Board of Adjustment will hold a public hearing on the application of applicant Mount Airy Holdings, LLC. ("Applicant") in connection with the property located at 161 Mount Airy Rd, Bernardsville, New Jersey, formally identified as Block 119, Lot 7, on the Tax Maps of the Borough of Bernardsville (the "Property" or the "Site"). Applicant has filed an appeal pursuant to N.J.S.A. 40:55D-70(a) from a determination of the Interim Zoning Officer, dated January 7, 2025, which denied Applicant's Zoning Permit Application for a change of occupancy to continue using the property as a contractor's storage yard. The subject of the appeal is Applicant's contention that the proposed use constitutes a lawful continuation of the Property's preexisting nonconforming contractor's storage yard, previously recognized by the Board under Resolution #21-12, and not a new or substantially different use requiring (D)(1) or (D)(2) use variance relief. Applicant seeks reversal of the January 7, 2026, determination and such other relief as may be necessary and proper.
