Investor's Trust Company, Trustee, pursuant to Deed of Trust from John A. Wright and Jennifer Wright, dated January 13, 2021, and of record as Instrument No. 202101280061322, in the Register’s Office for Knox County,
Tennessee, will on May 28, 2026 at about 11:00 o'clock A. M. at the front door of the Knox County Courthouse in Knoxville, Tennessee, offer for sale, and sell at public auction to the highest bidder for cash in hand, and in bar of the equity of redemption, any statutory or common law right of redemption, homestead, dower, marital share and all other exemptions and other rights which might defeat, reduce or affect the right to the Lender to sell the property for collection of this Indebtedness, which are waived in said Deed of Trust, property described as follows:
SITUATED in District Five (5) of Knox County, Tennessee, and within the 24th Ward of the City of Knoxville, Tennessee, and being known and designated as all of Lot 66, Shawnee Woods, as shown on map of same of record in Map Cabinet C, Slide 86-D in the Register's Office for Knox County, Tennessee, to which map specific reference is hereby made for a more particular description.
BEING the same property conveyed to John Wright, Jr. and wife, Jennifer Wright, by Warranty Deed from Richard Dana Watkins a/k/a Richard D. Watkins, and wife, Diann Elizabeth Watkins a/k/a Diann E. Watkins, dated April 27, 2010, and of record in Instrument No. 201005030068801 in the Register's Office for Knox County, Tennessee.
THIS conveyance is made subject to applicable restrictions, building set-back lines, all existing easements, and to all conditions shown on the recorded map.
The street address of the above described property is believed to be 4026 Hiawatha Drive Knoxville, TN 37919; Control No. 107MD-013, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.
In the event the high bidder should fail to comply and fulfill the submitted bid, the Trustee shall have the option of accepting the next highest bid in which the bidder is able to comply, or re-advertise and sell at a second sale.
The right is reserved to adjourn the day of the sale to another day certain without further publication, upon announcement at the time set forth above.
Said sale will be made subject to superior unpaid liens, claims and taxes, and to rights of tenants in possession, if any.
(a) TRUSTEE DOES NOT MAKE AND SPECIFICALLY NEGATES AND DISCLAIMS ANY REPRESENTATIONS, WARRANTIES (OTHER THAN THE COVENANTS TO BE CONTAINED IN THE TRUSTEE’S DEED), COVENANTS, AGREEMENTS OR GUARANTIES OF ANY KIND OR CHARACTER WHATSOEVER, WHETHER EXPRESS OR IMPLIED, ORAL OR WRITTEN, OF, AS TO, CONCERNING, OR WITH RESPECT TO: (i) THE VALUE, NATURE, QUALITY OR CONDITION OF THE PROPERTY, INCLUDING, WITHOUT LIMITATION, THE WATER, SOIL AND GEOLOGY, (ii) THE SUITABILITY OF THE PROPERTY FOR ANY AND ALL ACTIVITIES AND USES WHICH MAY BE CONDUCTED THEREON, (iii) THE COMPLIANCE OF OR BY THE PROPERTY WITH ANY LAWS, RULES, ORDINANCES OR REGULATIONS OF ANY APPLICABLE GOVERNMENTAL AUTHORITY OR BODY, (iv) THE HABITABILITY, MERCHANTABILITY, MARKETABILITY, PROFITABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE PROPERTY, OR (v) ANY OTHER MATTER WITH RESPECT TO THE PROPERTY, AND ANY PURCHASER IS ACQUIRING THE PROPERTY ON AN “AS IS,” “WHERE IS” BASIS AND “WITH ALL FAULTS”; (b) SPECIFICALLY, BUT NOT IN LIMITATION OF THE FOREGOING, TRUSTEE DOES NOT MAKE AND SPECIFICALLY NEGATES AND DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES REGARDING COMPLIANCE OF THE PROPERTY WITH ANY ENVIRONMENTAL PROTECTION, POLLUTION OR LAND USE LAWS, RULES, REGULATIONS, ORDERS OR REQUIREMENTS, INCLUDING, WITHOUT LIMITATION, THOSE PERTAINING TO SOLID WASTE, AS DEFINED BY THE U.S. ENVIRONMENTAL PROTECTION AGENCY REGULATIONS AT 40 C.F.R., PART 261, OR THE DISPOSAL OR EXISTENCE, IN OR ON THE PROPERTY, OF ANY HAZARDOUS SUBSTANCES, AS DEFINED BY THE COMPREHENSIVE ENVIRONMENTAL RESPONSE COMPENSATION AND LIABILITY ACT OF 1980, AS AMENDED, AND THE REGULATIONS PROMULGATED THEREUNDER; and (c), ANY PURCHASER SHALL RELY SOLELY ON ITS OWN INVESTIGATION OF THE PROPERTY AND NOT ON ANY INFORMATION PROVIDED OR TO BE PROVIDED BY TRUSTEE, ITS AGENTS OR CONTRACTORS. TRUSTEE SHALL NOT BE LIABLE OR BOUND IN ANY MANNER BY ANY ORAL OR WRITTEN STATEMENTS, REPRESENTATIONS OR INFORMATION PERTAINING TO THE PROPERTY OR THE OPERATION THEREOF, FURNISHED BY ANY PARTY PURPORTING TO ACT ON BEHALF OF TRUSTEE. ANY PURCHASER MUST AGREE THAT THE TRUSTEE SHALL NOT BE RESPONSIBLE OR LIABLE TO ANY PURCHASER FOR ANY CONSTRUCTION DEFECTS, ERRORS OR OMISSIONS OR ON ACCOUNT OF ANY OTHER CONDITIONS AFFECTING THE PROPERTY. THE FOREGOING SHALL NOT BE DEEMED TO LIMIT A PURCHASER’S RIGHT TO ASSERT CLAIMS UNDER MANUFACTURER, SUPPLIER, CONTRACTOR AND SUBCONTRACTOR WARRANTIES ASSIGNED TO IT AT CLOSING (IF ANY).
Said sale is being made upon the request of Home Federal Bank of Tennessee, the owner and holder of the indebtedness secured by said Trust Deed due to the failure of the makers to comply with all provisions of said Trust Deed.
