SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE
WHEREAS, on April 12, 2024, MARY MARTIN AND ALEXANDER MARTIN, WIFE AND HUSBAND, AS
JOINT TENANTS, executed a Purchase Money Deed of Trust to ALBERT B. WHITE AS, as Trustee and, MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR AMERICAN MORTGAGE BANK, ITS SUCCESSORS AND ASSIGNS, as Beneficiary, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Madison County, Mississippi, in Book T - 4429, Page 634 as Instrument Number 1002609; which Deed of Trust has been duly transferred and assigned to NEWREZ LLC D/B/A SHELLPOINT MORTGAGE SERVICING by assignment recorded on September 18, 2025, in Book T - 4598, Page 512 as Instrument Number 1035233 in the office of the Chancery Clerk of Madison County, Mississippi; and
WHEREAS, default has occurred in the payment of the indebtedness secured by said deed(s) of trust, and NewRez LLC d/b/a Shellpoint Mortgage Servicing, as beneficiary, has authorized and instructed Padgett Law Group as substitute trustee to foreclose said deed(s) of trust by advertisement and sale at public auction in accordance with the statutes made and provided therefor.
THEREFORE, notice is hereby given that pursuant to the power of sale contained in said deed(s) of trust and in accordance with the statutes made and provided therefor, the said deed(s) of trust will be foreclosed and the property covered thereby and hereinafter described will be sold at public auction to the highest bidder for cash at the Front door of the Madison County Courthouse, at 128 W. North Street, at Canton, Mississippi, and will sell within legal hours (being between the hours of 11:00 AM and 4:00 PM) on May 21, 2026, to satisfy the indebtedness now due under and secured by said deed(s) of trust.
Padgett Law Group will convey only such title as vested in it as Substituted Trustee.

BEGIN AT AN IRON PIN OF THAT CERTAIN TRACT OF REAL PROPERTY CONVEYED TO ORVILLE H. JOHNSON AND WIFE, RUBY T. JOHNSON, BY WARRANTY DEED FROM WILLIAM RICHARD YATES AND WIFE, FELICITA M. YATES, DATED DECEMBER 1, 1980 AND RECORDED IN BOOK 172 AT PAGE 694 OF THE LAND RECORDS IN THE OFFICE OF THE CHANCERY CLERK OF MADISON COUNTY, MISSISSIPPI, AND FROM SAID POINT OF BEGINNING, RUN THENCE NORTHERLY ALONG THE WEST LINE OF THE AFORESAID TRACT OF PROPERTY DESCRIBED IN BOOK 172 AT PAGE 694 FOR A DISTANCE OF 210 FEET TO A POINT; THENCE WESTERLY PARALLEL TO THE NORTH RIGHT OF WAY LINE OF MISSISSIPPI HIGHWAY 16 FOR 210 FEET TO A POINT; THENCE SOUTHERLY PARALLEL TO THE WESTERN LINE OF THE ORVILLE H. JOHNSON AND RUBY T. JOHNSON TRACT AS DESCRIBED IN BOOK 172 AT PAGE 694 FOR 210 FEET, MORE OR LESS, TO A POINT ON THE NORTH RIGHT OF WAY LINE OF MISSISSIPPI HIGHWAY 16; THENCE NORTHEASTERLY ALONG THE NORTH LINE OF THE RIGHT OF WAY OF SAID HIGHWAY 16 TO THE POINT OF BEGINNING OF THE TRACT HEREIN DESCRIBED, CONTAINING 1 ACRE, MORE OR LESS.
AND BEING THE SAME PROPERTY DESCRIBED IN INSTRUMENT RECORDED IN BOOK 276 AT PAGE 48.
The Financial Crimes Enforcement Network (“FinCEN”), a bureau of the U.S. Department of Treasury, now requires the collection, certification and reporting of certain information relating to non-financed transfers of real property to legal entities and/or trusts, which such information the successful bidder(s) shall be expected to provide to the auctioneer at the time of the subject sale. Interested bidders with questions regarding the necessary information to be provided are hereby directed, generally, to FinCEN’s website and, more specifically to the FinCEN Real Estate Report located in the forms bank thereof. The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
