LEGAL NOTICE ARIZONA DEPARTMENT OF WATER RESOURCES BEFORE THE DIRECTOR In the matter of permit application number 72-563502.0006 for a Groundwater Savings Facility located within the Avra Valley Sub-basin of the Tucson Active Management Area, the Director gives notice that BKW Farms, Inc. has filed the above-referenced permit renewal application pursuant to Arizona Revised Statute (A.R.S.) § 45-812.01. The Groundwater Savings Facility is located within the exterior boundaries of BKW Farms Milewide. The facility proposes to save up to a maximum of 612.8 acre-feet of groundwater annually by substituting deliveries of CAP water to landowners within the district in lieu of pumping groundwater. The proposed duration of the permit is 5 years. A copy of the groundwater savings facility permit application is available for review at the Department, or electronically, upon receipt of a public records request. A public records request can be submitted online here: https://app.azwater.gov/eforms/Forms/Request/DWR_Request.aspx Objections to the issuance of this permit may be filed by persons who may be adversely affected by this project and must be filed, in writing, with the Docket Supervisor of the Department of Water Resources, Legal Division, 1110 West Washington Street, Suite 310, Phoenix, Arizona 85007, within fifteen (15) days after the last day of publication of this notice. For this application, the final date on which an objection may be filed is June 12, 2026. Objections are limited to whether the application for the groundwater savings facility permit meets the criteria of A.R.S. § 45-812.01. An objection shall state the name and mailing address of the objector, be signed by the objector, their agent, or attorney, and must clearly set forth reasons why the permit should not be issued.
