NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF CHATHAM
Under and by virtue of the power of sale contained in that certain Deed to Secure Debt, Security Agreement and Assignment of Leases and Rents, from Bell Homes, LLC (“Grantor”), to and in favor of Velocity Commercial Capital, LLC (“Original Lender”) dated May 19, 2021, recorded May 21, 2021 at Deed Book 2378, Page 9, Chatham County, Georgia records; as assigned to U.S. Bank Trust Company, National Association as Trustee for Velocity Commercial Capital Loan Trust 2021-2 (“Lender”) by virtue of that Assignment of Deed to Secure Debt, Security Agreement and Assignment of Leases and Rents, recorded October 7, 2022 at Deed Book 2931, Page 505, aforesaid, Georgia records (the “Security Deed”) securing that certain Term Note, dated May 19, 2021, in the original principal amount of $133,000.00 (the “Note”); there will be sold at public outcry by Lender as attorney-in-fact of Grantor to the highest bidder for cash between the legal hours for sale before the Courthouse door or any other officially designated area for such foreclosure sales in Chatham County, Georgia, on the first Tuesday, in July 2026, the following described property (the “Premises”) to wit:
All that certain lot, tract or parcel of land situate, lying and being in the City of Savannah, Chatham County, Georgia and known as the southern parts or portions of Lots Eighty-seven (87) and Eighty-eight (88), Demere Ward; said property being more particularly described as follows: Beginning at the point where the Northerly side of Church Street intersects the Easterly side of Ogeechee Road as a point of beginning and running thence in a Northeasterly direction sixty and two tenths (60.2) feet, thence in a Southeasterly direction eighty-six and sixty five one hundredths (86.65) feet to the Western line of said Lot 86, said Ward, thence south along the western line of said Lot 86, said Ward, twenty-ono and seven hundredths (21.07) feet to the Northern side of a lane, thence Westwardly along the Northern side of said lane seventy-three and three hundredths (73.03) feet to the intersection of said lane with Church Street: thence in a Northwesterly direction along the North side of Church Street thirty-seven and three tenths (37.3) feet to the point of beginning: said portions of said lots being contiguous and as a whole bounded on the North by the Northern portions of said Lots 87 and 88, said Ward, on the East by Lot 86, said Ward, on the South by said lane, on the southwest by Church Street and on the Northwest by Ogeechee Road, all as more particularly shown on said map of said lots by W. O'D Rockwell, C.E., dated January 7, 1926.
Also an easement or right-of-way covering a portion of the northern part of said Lot 88, adjoining the property above described, the easement and right-of-way hereby granted being more fully described in that certain deed from J.S. Perry to Hussars Realty Co., dated August 9, 1929, and recorded in the Office of Clerk of the Superior Court of Chatham County, Georgia, in Deed Book 25-V, Page 387.
Said property having an address of 2210 Ogeechee Road. Savannah, GA 31415, and a property tax number of 2-0073-02-002.
This being the same property conveyed to Bell Homes, LLC by Administratrix' Deed from Melanie L. Marks, as Administratrix of the Last Will and Testament of John Henry Reed, dated December 30, 2019, and recorded in Deed Book 1812. Page 608, Chatham County records.
FURTHER LESS AND EXCEPT that property, if any, released of record.
The indebtedness evidenced by the Note is due and payable and remains unpaid. The Security Deed therefore has become and is now foreclosable according to its terms. Accordingly, the Premises will be sold at public outcry pursuant to the terms of the power of sale provided in the Security Deed.
The Premises will be sold on an “as is, where is” basis without recourse against Lender and without representation or warranty of any kind or nature whatsoever by Lender with respect thereto.
The proceeds of the sale are to be applied first to the expenses of the sale and all proceedings in connection therewith, including attorneys’ fees (notice of intention to collect attorneys’ fees having been given), then to the payment of all sums secured by the Security Deed, and the remainder, if any, will be paid to the person or persons legally entitled thereto, all as provided in the Note and Security Deed. The Premises shall be sold as the property of Grantor, subject to all restrictions, easements and other matters of record that are prior to the Security Deed and to which the Security Deed is subject and to any unpaid city, county and state ad valorem taxes or assessments relating to the Premises.
ATTENTION ALL PROSPECTIVE BIDDERS: On March 1, 2026, the data collection and reporting requirements under the U.S. Financial Crimes Enforcement Network (FinCEN) new Anti-Money Laundering Rule (the “Rule”), found at 89 FR 70258, went into effect. The Rule applies to certain residential real estate sale transactions (including nonjudicial foreclosures) where the transfer is to a legal entity or trust, and which includes cash purchases, private financing or financing provided by an institution not subject to a federal Anti-Money Laundering or Suspicious Activity Report requirement. As part of this Rule, purchasers and sellers are required to provide additional information and documentation about themselves, their legal entities, and/or the source of funds used in the reportable transaction. The collection of this information and documentation is required to comply with the Rule’s federal reporting requirements. To the best knowledge and belief of the undersigned, the party in possession of the Premises is Grantor, Bell Homes, LLC, or a tenant or tenants and said property is more commonly known as 2210 Ogeechee Road, Savannah, GA, 31415-7846.
