NOTICE OF PUBLIC HEARING
INTENT TO ENACT ORDINANCE NO. 1412
ORDINANCE APPROVING APPOINTMENT OF SOLICITOR, INTEREST ASSESSMENT, AND ATTORNEY FEES AND COLLECTION FEES ADDED TO THE AMOUNT COLLECTED AS PART OF UNPAID MUNICIPAL CLAIMS FOR DELINQUENT ACCOUNTS
NOTICE IS HEREBY GIVEN that the Borough Council of the Borough of East Stroudsburg, Monroe County Pennsylvania (the "Borough") will hold a public hearing at the East Stroudsburg Municipal Building at 24 Analomink Street, East Stroudsburg, PA 18301 on Tuesday, June 2, 2026, at 7:15 p.m., prevailing local time, during the Borough Council's regularly scheduled business meeting, to enact Ordinance No. 1412, which Ordinance authorizes the collection of attorney fees, collection costs, and interest to be added to Borough municipal claims, the appointment of special counsel for collection purposes, and the authorization to enter into an agreement for the enforcement and collection of delinquent claims. At the reconvention of the same meeting, the Borough Council will, if in order, consider and vote upon the Ordinance as well as conduct any other business which may come before the Borough Council at that time.
The proposed Ordinance provides for the collection of unpaid water, sewer, and solid waste accounts pursuant to the Municipal Claims and Tax Liens Act, including §7106 relating to the recovery of attorney fees and collection costs, including the authorization for the collection of attorney fees, collection costs, and interest as approved by Borough Council and determined to be reasonable and necessary for the collection of delinquent municipal claims, to be added to municipal claims, which amounts shall be added to and collected as part of the municipal lien, the appointment of special counsel for collection purposes, and the authorization to enter into an agreement for the enforcement and collection of delinquent municipal claims, including enforcement through in rem proceedings where applicable.
