If the Hearing Authority affirms the order and finds there has been a willful failure to comply with the order, a fine in an amount not exceeding $5,000 may be imposed. If you or your representative does not appear, the matter will be determined in your absence and a civil penalty may be imposed. If the orders have not been complied with in a predetermined timeframe, and have been affirmed or modified by the Hearing Authority, the Unsafe Building Law provides that a court may be requested to grant injunctive relief, impose a court ordered forfeiture, appoint a receiver, or require the work to be accomplished by a contractor. If a contractor is hired by the City, all persons having a fee interest, life estate interest, or equitable interest of a contract purchaser in the unsafe premises is jointly and severally responsible for costs incurred by the division.
