ORDINANCE NO. 2025-1638 … AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF GOODYEAR, MARICOPA COUNTY, ARIZONA, ADOPTING “CITY OF GOODYEAR ENGINEERING DESIGN STANDARDS AND POLICIES MANUAL 2025 EDITION”; REPEALING ORDINANCE NO. 17-1359; … WHEREAS, the “City of Goodyear Engineering Design Standards and Policies Manual” impose standards for the design and construction of infrastructure improvements in the city of Goodyear; and WHEREAS, “City of Goodyear Engineering Design Standards and Policies Manual 2012” was adopted by the Mayor and City Council of the city of Goodyear on December 10, 2012 by Ordinance No. 12-1276; and WHEREAS, the “City of Goodyear Engineering Design Standards and Policies Manual 2017 Edition” was adopted by the Mayor and City Council of the city of Goodyear on August 28, 2017 by Ordinance No. 17-1359; and WHEREAS, since the adoption of the “City of Goodyear Engineering Design Standards and Policies Manual 2017 Edition”, city staff has identified changes which are needed to various standards for clarification purposes and for the health and safety of the public; and WHEREAS, the City of Goodyear Engineering Design Standards and Policies Manual 2025 Edition includes an analysis of current industry conditions, including process improvements needed to clarify existing procedures for both staff and the public; and WHEREAS the Mayor and Council of the city of Goodyear find the adoption of this ordinance to be in best interests of the public health, safety and welfare; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GOODYEAR, MARICOPA COUNTY, ARIZONA, AS FOLLOWS: SECTION 1. ADOPTION OF CITY OF GOODYEAR ENGINEERING DESIGN STANDARDS AND POLICIES MANUAL 2025 EDITION That certain document titled “City of Goodyear Engineering Design Standards and Policies Manual 2025 Edition” attached hereto as Exhibit A of which three copies are on file with the City Clerk of the city of Goodyear, Arizona, which document is declared a public record herein, and is hereby referred to, adopted and made a part hereof as if fully set forth in this ordinance. Either three paper copies or one paper copy and one electronic copy maintained in compliance with section A.R.S. 44-7401 of the aforementioned SECTION 2. REPEAL OF ORDINANCE NO. 17-1359 Ordinance No. 17-1359 is hereby repealed as of the effective date of this Ordinance No. 2025-1638. The repeal of this ordinance does not affect the rights and duties that matured or penalties that were incurred and proceedings that were begun before the effective date of the repeal. SECTION 3. CORRECTIONS The City Engineer, City Clerk and the codifiers of this ordinance are authorized to make necessary clerical corrections to this ordinance, including, but not limited to, the correction of scrivener’s/clerical errors, references, numbering, section/subsection numbers and references thereto. SECTION 4. ABRIDGMENT OF OTHER LAWS Except where expressly provided, nothing contained herein shall be construed to be an abridgement of any other ordinance, regulation, or requirement of the city of Goodyear. SECTION 5. SEVERABILITY If any section, subdivision, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining provisions of the ordinance or parts thereof. SECTION 6. PENALTIES Any person who violates any provision of the “City of Goodyear Engineering Design Standards and Policies Manual 2025 Edition”, shall be subject to penalties set forth in Article 1-8 of the city of Goodyear Code of Ordinances as it may be amended from time to time, and which currently provides: § 1-8-1 Penalty. (A) Any person found guilty of violating any provisions of this code, except as otherwise provided in this code, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not to exceed $2,500 for an individual and not more than $20,000 for an enterprise or by imprisonment for a period of not to exceed six months, or by both such fine and imprisonment. Each day that a violation continues shall be a separate offense punishable as hereinabove described. The term ENTERPRISE as used in this subsection shall mean any corporation, partnership, association, labor union or other entity or any group of persons associated in part although not a legal entity. (B) Any violation of or failure or refusal to do or perform any act required by Chapter 13 of this code constitutes a civil traffic violation. Civil traffic violations are subject to the provisions of A.R.S. Title 28, Chapter 6, Arts. 20 and 21 and amendments thereto. (C) Notwithstanding any provisions to the contrary in this code providing for enforcement of violations of this code as misdemeanors or petty offenses, violations of any provision of this code and violations of any proscription, requirement or duty set forth in any ordinance incorporated into this code or any other ordinance of the City are declared to be civil code violations which may be adjudicated and enforced by the City court pursuant to Chapter 18 of this code, as an additional enforcement alternative to other remedies provided in this section or remedies and procedures provided for specifically in this code or other ordinance. Use of this civil code enforcement alternative is not mandatory and shall be at the discretion of the City official undertaking enforcement action on an alleged violation of this code or other ordinance. SECTION 7. EFFECTIVE DATE This ordinance shall become effective at the time and in the manner prescribed by law.
