RESOLUTION [To Set a Public Hearing to Declare the Abundance of Overgrown Grass and Weeds at 172 Maple Street, 710 Taylor Street, and 309 Angela Street, to be Unsafe and a Public Nuisance and Order Their Abatement Pursuant to Chapter 46 et seq., City of Prattville Code of Ordinances.] WHEREAS, an abundance of overgrown grass and weeds: 1. is injurious to the public health, safety, and general welfare of the community by providing a breeding ground and shelter for rats, mice, snakes, mosquitoes, and other vermin; 2. may cause the further spread of weeds; 3. may hide debris, such as glass or metal, that could inflict injury on a person going to such property; 4. may also pose a fire hazard and respiratory hazard; and WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected the properties and determined the existence of an abundance of overgrown grass and weeds at 172 Maple Street, 710 Taylor Street, and 309 Angela Street; and WHEREAS, the Autauga and Elmore County tax records list the property owner(s) as follows: 172 Maple Street - LRP Properties LLC, with an address of 1587 Upper Kingston Road, Prattville, AL 36067, to Parcel Number 19 04 17 1 009 003.000; 710 Taylor Street - Thrift Annie Laura Stoudemire, with an address of 710 Taylor Street, Prattville, AL 36067, to Parcel Number 19 02 09 2 002 011.000; 309 Angela Street - Wallace Nick Elijah, with an address of 309 Angela Street, Prattville, AL 36066, to Parcel Number 26 04 19 0 001 004.000; and WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the Code Enforcement Officer gave written notice to the owner(s) of said properties on August 5, 2025, August 12, 2025, and August 21, 2025, respectively, to correct, remedy, or remove the abundance of overgrown grass and weeds within ten (10) days; and WHEREAS, the owner(s) of said properties have failed and/or refused to correct, remedy, or remove said condition by the expiration of said notice; and WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City Council to declare the abundance of overgrown grass and weeds to be a public nuisance and abate the same; and WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering their abatement by the City Council initiates a fine for the first violation and designation on the repeat offender registry. NOW, THEREFORE, BE IT RESOLVED THAT: 1. the City Council of the City of Prattville declares the abundance of overgrown grass and weeds at said properties to be a public nuisance and has therefore initiated the abatement process; and 2. the owner(s) of said properties are ordered to abate said nuisance and appear before the City Council at a Public Hearing at 6:00 p.m. on October 21, 2025, at Prattville City Hall; and 3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the Public Hearing; and 4. the fine of $100.00 shall be assessed to the owner(s) of said properties in addition to any costs incurred for the abatement process; and 5. said properties shall be placed on the repeat offender registry for a period of three (3) years; and 6. the notice of Public Hearing on the matter, as required by law, will be provided in a publication of general circulation, by certified mail, and by signage on the subject properties.
