ORDINANCE [To Amend City of Prattville Code of Ordinances, Chapter 50 Offenses and Miscellaneous Provisions, Article III Offenses Involving Public Peace and Order, Division 1 Generally, Section 50-49.] BE IT ORDAINED by the City Council of the City of Prattville that City of Prattville Code of Ordinances, Chapter 50 Offenses and Miscellaneous Provisions, Article III Offenses Involving Public Peace and Order, Division 1 Generally, Section 50-49 is hereby amended to read as follows: Section 50-49. – Drinking, open possession of or attempt to drink, sell, etc., liquors, wines or malt brewed beverages in public places. (a) It shall be unlawful for any person to drink, to have in open or unconcealed possession or custody, for drinking, selling, serving, dispensing, or to give away, or to attempt to drink, sell, serve, dispense or give away any liquor, wine or malt or brewed beverages, while upon any street, avenue or alley, or in any public building or upon any public property, or while in any other public place. As used in this section, the term "public place" means and includes any place or gathering which the public generally attends or is admitted to either by invitation, common consent or right, or by payment of an admission or other charge, and, without limiting the generality of the foregoing, shall include any theater or other place of amusement and any athletic contest; provided that such term "public place" shall not mean or include premises which have been duly licensed by the City for sale thereon of such beverages, the Doster Memorial Community Center located at 424 South Northington Street, the Prattville Senior Citizens Center located at 334 Doster Road, 342 South Chestnut Street, 124 West Main Street, and the park area located along South Court Street, provided that proper application has been made ten days prior to the event to the mayor and the mayor has issued a permit. (b) This section does not apply to possession of alcoholic beverages in motor vehicles. THIS Ordinance shall become effective upon its passage and execution as provided by law.
