NOTICE OF SALE
In accordance with the Judgment and Decree of Foreclosure by Judicial Sale entered on March 5, 2025, in the above captioned action brought to foreclose that certain mortgage given by Brad Howort and Lisa Howort to Santander Bank, N.A. f/k/a Sovereign Bank, N.A. f/k/a Sovereign Bank, dated March 31, 2006, and recorded in Book 683, at Page 70, of the Town of Essex Land Records, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on October 29, 2025 at 02:00 PM at 10 Cherokee Avenue, Essex Jct., VT 05452 all and singular the premises described in said mortgage,
To Wit:
Being all and the same land and premises conveyed to William J. Adams and Lisa Ann Sterling by warranty deed of William W. Adams and Kathleen C. Adams dated July 16, 1999 and recorded at Book 414, Pages 603-604 of the Town of Essex Land Records.
A lot of land with all buildings thereon, situated on the southwesterly side of Cherokee Avenue, the dwelling house being known and designated as No. 10 Cherokee Avenue, said lot having a frontage thereon of 60 feet, a southeasterly line of 114 feet, a northwesterly line of 108.65 feet, a southwesterly line of 60.2 feet, and being Lot 905 as shown on a plan of Indian Acres Development, Richard Hayden, Owner, Fifth Revision, Plan F, dated March 1953 and recorded in Volume 53 on Page 44 of said Land Records.
Said lot is subject to certain conditions, restrictions and limitations as set forth in Volume 50 on Page 2 of said Land Records.
Also being all and the same land and premises conveyed to Bradley Howort and Lisa Howort by Warranty Deed of William J. Adams and Lisa Ann Adams (f/k/a Lisa Ann Sterling) dated March 31, 2006 and recorded April 3, 2006 in Book 683, at Page 68 of the Town of Essex Land Records.
Reference is hereby made to the aforementioned instruments, the land records thereof and the references therein contained, in further aid of this description.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale.
Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. The sale is subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens, if any, which take precedence over the said mortgage above described.
The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
