The Applicant seeks an use variance and a C-Variance from section 131 - minimum side yard setback (5ft required 3.44 ft proposed and pre-existing), combined side yard setback (15ft required, 13.73 feet proposed and pre-existing), both C Variances are pre-existing non-conforming conditions. Variance from section 131-39 non-conforming uses and lots: (E) alterations. A nonconforming building or structure may be reconstructed, but not enlarged or extended unless said building is changed to a building conforming to the zoning requirements. The existing single-family dwelling is non-conforming due to set back requirements and any other relief so the Board deems just and necessary for the premises. The Board of Adjustment will hear this appeal at 6:00pm on October 21, 2025 on the second floor of Borough Hall, 176 Park Avenue, Rutherford, New Jersey.
