SALE OF REAL ESTATE
UNDER G.L. c.183A, Section 6 and c.254, Section 5A
By virtue of a Judgment and Order of the Dudley District Court, (Civil Action No. 2564CV000271) in favor of the Trustees of the North End Condominium Trust (hereinafter the “Trust”) and against Angele Ngounou Epse Fotso Kamga, establishing a lien pursuant to M.G.L. c.183A, Section 6 on the real estate known as and located at 600 Worcester Street, Unit #4, Southbridge, MA 01550 in the North End Condominium, for the purpose of satisfying said lien pursuant to M.G.L. c.254, Section 5A, the real estate will be sold at Public Auction commencing at 11:00 A.M. on October 24, 2025 at 600 Worcester Street, Unit #4, Southbridge, MA 01550. The real estate to be sold is more particularly described as follows:
Unit No. 4, in Building 600, of the North End Condominium, a condominium located at 600 Worcester Street, Southbridge, Worcester County, Massachusetts created by Master Deed dated July 10, 2003 and recorded with the Worcester District Registry of Deeds on July 23, 2003, in Book 30898, Page 230 (hereinafter referred to as “Master Deeds”, as amended by instrument(s) of record, together with an undivided interest in the common areas and facilities of said Condominium as set forth in said Master Deed Exhibit “C”, and as shown on Site Plan recorded with the Worcester District Registry of Deeds in Plan Book 793, Plan 69.
The mailing address of this Unit is 600 Worcester Street, Unit 4, Southbridge, MA 01550.
Said Unit 4 contains 766 square feet, more or less, and is laid out as shown on a plan attached to the Unit Deed recorded with the Worcester District Registry of Deeds in Book 31988, Page 72, to which is affixed a verified statement in the form prescribed by General Laws Chapter 183A, Section 9, and which plan is a copy of the plans filed with said Master Deed.
Said Unit is to be used for residential purposes only.
Said Unit is conveyed together with:
(a) and undivided interest in the common areas and facilities described in the
North End Condominium Trust Master Deed Exhibit “C”; and
(b) The benefit of, and subject to, all easements, rights, obligations, restrictions, agreements and provisions contained in said Master Deed, by Declaration of Trust creating North End Condominium Trust and the By-Laws contained therein, all as recorded with the Worcester District Registry of Deeds in Book 30898, Pages 230 and 297, as amended by instrument(s) of record, and the Rules and Regulations from time to time promulgated thereunder as authorized therein, and the Plans recorded therewith , which are hereby incorporated by reference and constitute covenants running with the land and are and shall remain binding upon any Unit and persons claiming through or under them.
This conveyance is also made subject to and with the benefit of the provisions of said General Laws, Chapter 183A as now in force and as from time to time amended, and subject also to (a) municipal taxes attributable to such Unit and common areas and facilities, assessed as of the current tax year that are not yet due and payable, and (b) building and zoning laws.
Being the same premises conveyed to Jeanne A. McGovern by deed of Glenn A. Forcier dated and recorded September 8, 2017 with the Worcester District Registry of Deeds in Book 57704, Page 80.
For title, see Quitclaim Deed to Angele Ngounou Epse Fotso Kamga, dated October 16, 2018 and recorded with Worcester District Registry of Deeds in Book 59577, Page 72.
In the event of a typographical error or omission contained in this publication, the description of the real estate contained in said Unit Deed shall control.
TERMS OF SALE:
1.) A non-refundable deposit payable by certified check or by bank check in the amount of Ten Thousand and No/100 ($10,000.00) Dollars shall be payable at the time and place of the Auction.
2.) The balance of the purchase price is to be paid to the Trust, by its counsel, by certified check or by bank check within thirty (30) days of the Auction.
3.) An Auctioneer’s Release Deed will be issued to purchaser, upon payment of the balance of the purchase price, within thirty (30) days of the Auction. The Deed shall convey the premises subject to, and with the benefit of, all restrictions, easements, improvements, outstanding tax titles, municipal or other public taxes, assessments, liens, or claims in the nature of liens, and existing encumbrances of record senior to the lien hereby being satisfied, whether or not reference to such restrictions, easements, improvements, outstanding tax titles, municipal or other public taxes, assessments, liens, or claims in the nature of liens or encumbrances is made in the Auctioneer’s Release Deed.
4.) Additionally, and not by way of limitation, the sale of the real estate shall be subject to and with the benefit of any and all tenants, tenancies and occupants if any.
5.) No representation is or shall be made as to any amount of real estate taxes which may be due and outstanding.
6.) The successful bidder shall pay the future condominium common charges (including any special assessment installments that become due), commencing with the date of the Auction.
7.) No representation is or shall be made as to any other mortgages, liens or encumbrances of record.
8.) No representation is or shall be made as to the condition of the real estate or the Condominium. The real estate shall be sold “as is”.
9.) Other terms, if any, shall be announced at the Auction.
10.) This Auction is subject to and in accordance with the Judgment and Order, recorded with the Worcester District Registry of Deeds at Book 72478, Page 194, a copy of which may be obtained from the Trust’s counsel, David E.
