NOTICE OF SUBSTITUTED TRUSTEE'S SALE
WHEREAS, on 12/01/2004, PERCY FULTS, AN UNMARRIED PERSON AND PRENTISS FULTS, AN UNMARRIED PERSON executed a promissory note payable to the order of HOMECOMINGS FINANCIAL NETWORK, INC., as Lender,
WHEREAS, the aforesaid promissory note was secured by a Deed of Trust dated 12/01/2004, executed by PERCY FULTS, AN UNMARRIED PERSON AND PRENTISS FULTS, AN UNMARRIED PERSON and being recorded on 12/10/2004 in Book 1861, Page 0748 as Instrument No. 458830 of the records of the Madison County, State of Mississippi; and which aforesaid Instrument conveys to ATTY. ARNOLD M. WEISS, Trustee and to HOMECOMINGS FINANCIAL NETWORK, INC., as Lender, Mortgage Electronic Registration Systems, INC., as Beneficiary, the hereinafter described property; and
WHEREAS, Mortgage Electronic Registration Systems, INC., assigned said Deed of Trust to The Bank of New York Mellon Trust Company, National Association fka The Bank of New York Trust Company, N.A. as successor to JPMorgan Chase Bank, N.A., as Trustee for Residential Asset Mortgage Products, Inc., Mortgage Asset-Backed Pass-Through Certificates Series 2005-RS1 via an instrument filed of record on March 30, 2009 in Book 2409, Page 0475 as Instrument No 587397 in the office of the Clerk of the Madison County, State of Mississippi; and
WHEREAS, THE BANK OF NEW YORK MELLON TRUST COMPANY, NATIONAL ASSOCIATION FKA THE BANK OF NEW YORK TRUST COMPANY, N.A. AS SUCCESSOR TO JPMORGAN CHASE BANK, N.A., AS TRUSTEE FOR RESIDENTIAL ASSET MORTGAGE PRODUCTS, INC., MORTGAGE ASSET-BACKED PASS-THROUGH CERTIFICATES SERIES 2005-RS1 appointed WESTERN PROGRESSIVE - MISSISSIPPI, INC, as Substitute Trustee in the place of the aforementioned original Trustee via an instrument dated 07/08/2025 and record on 07/11/2025 in Book T-4575, Page 411 as Instrument No. 1030996 of the records of the Madison County, State of Mississippi and
WHEREAS, default having occurred under the terms and conditions of said promissory note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Western Progressive - Mississippi, Inc, the Substituted Trustee in said Deed of Trust will on 10/20/2025, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the South Door of the Madison County Courthouse, 128 West North Street, Canton, MS 39046, the following described property located and situated in Madison County, Mississippi, to wit:
LOT 85, HARVEY CROSSING II-A, A SUBDIVISION ACCORDING TO THE MAP OR PLAT THEREOF ON FILE AND OF RECORD IN THE OFFICE OF THE CHANCERY CLERK OF MADISON COUNTY AT CANTON, MISSISSIPPI IN PLAT CABINET D AT SLIDE 87, REFERENCE TO WHICH IS HEREBY MADE IN AID OF AND AS A PART OF THIS DESCRIPTION
More commonly known as: 108 SOUTHWOOD DRIVE, CANTON, MS 39046
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand, and gravel in or under subject property.
As the undersigned Substituted Trustee, Western Progressive - Mississippi, Inc, will convey only such title as is vested in it under said Deed of Trust.
